Claiming ownership of the motor vehicle of a deceased person

(Querist) 24 May 2026 This query is : Resolved 
How to transfer the ownership of a motor vehicle with the RTO on the death of the owner under the following circumstances.
1. The vehicle had an insurance as required under the Act and in the policy (a) the nominee had been specified. (b) no nominee had been specified or the nominee also is deceased.
2. There is a will covering all that the deceased owned without specifying the motor vehicle.
3. There is no will.

You can produce the deceased person's death certificate, legal heir certificate, and vehicle documents to the concerned RTO within 30 days of the deceased's death. Please enclose the Original deceased owner's Registration Certificate (RC) and the original vehicle RC Insurance Certificate (valid, updated policy in the vehicle's name), Form 31 in duplicate, an affidavit on a non-judicial stamp paper, signed by the successor and attested by an Executive Magistrate, all the other legal heirs No Objection Certificates (NOC), letters of consent from all other legal heirs stating they have no objection to you taking ownership of the bike. A physical pencil tracing of the motorcycle's chassis and engine numbers.
