Hello,

I have number of doubt as i just joined the group.

1) In the maintenance case is there any fixed percentage rules like 20 %,50%,80% amt that court order to pay wife.
2) can i take in advance notice bail on the bases of doubt that my wife can imposed me 498a & DV case.

Yes, if any complaint is lodged anywhere against you you can apply for notice bail.
However in all states of India the facility of notice bail is not available like WB, UP, Odhisa etc.

1. Yes, you can take notice bail after a complaint has been lodged against you provided the system of giving notice bail is in vouge in your state,

2. There is no fixed percentage of amount for allowing maintenance. It is decided by the Court depending on the earning of the husband, the status of the couple etc. Normally it is around 1/3rd of husband's earning.

in maharashtra only if FIR is lodged can you apply for AB . no fixed percentage as to amount that husband would have to pay for maintenance

1. There is no such criteria.

2. Bail cannot be provided just on the basis of doubt of filing the complaint/case.

Well advised by experts on the issue. A bail application cannot be moved before a court merely on the basis of apprehension of her complaint in the future. the quantum of maintenance depends on various factors and yard sticks. There is no fixed term or uniform law for ordering the quantum of maintenance amount.
