Departmentalinquiry

(Querist) 23 April 2012 This query is : Resolved 
Sir thaknks to you all experts whl gave me precious advice. I had posted whether the PO can seek production of fresh witnesses. Today the IO rejectd his application.
Now I request you all to advice
Allthe departmental witness have been examined and cross examined. Two deliquent employees were also examined in chief and cross examined by the PO
Now the presenting officer will submit his written brief
My question is
1. The written brief should contain only statements related to charges or anything fresh the PO can add
2. What further steps should I take

I say that the ddepartment has produced no evidences either in documentary nature. Only the complainant had said against me. No other departmental witnesses have said anything against me

Why are you starting thread after thread?

Anyway the qeustions you are asking a specific and can be replied only if the full set of papers are available to your nearst available expert in person.

1. Nothing fresh can be added and even if added, the IO has not to go into fresh charges or material.

2. You should also file written submissions. You should plead this fact in your submissions and should contest that nothing has been brought against you in the evidence so no charge stand proved against you.

The PO brief should be restricted only to the evidence adduced during inquiry proceedings in proof of the charge. Nothing extraneous should be added. If added, the I.O. should not take note of that. The Defence Brief must also point out about any such thing of the P.O., if not related to charge and having not been discussed during the inquiry proceedings to prove the charge.
