(Querist) 22 November 2011 This query is : Resolved
Under which special circumstances, the court can prepone the date of hearing of a case?

(However, as per code, the case must be heard in day to day proceedings)
ajay sethi (Expert) 22 November 2011
on grounds of urgency .

any party can make an application to court for preponement notice to be given to other side . after haering both sides court can direct preponement of hearing

Agree with expert
Raj Kumar Makkad (Expert) 22 November 2011
Urgency should be based upon some convincing reason justifying preponement in the interest of justice.
Kiran Kumar (Expert) 22 November 2011
day to day proceedings are generally not possible in Indian courts due to paucity of time and heavy pendency.

but the courts are still doing their best to follow the procedure.
Devajyoti Barman (Expert) 23 November 2011
Only in exceptional cases that too when directed by the High Court or the Supreme Court the lower court conducts day to day trial.

nothing to disagree.

Do you mean advance hearing?

prabhakar singh (Expert) 24 November 2011
Mr. Arunagiri!I hope, to say it by illustration author wants a case heard on 01 DEC.11 ,the date in which is already fixed for 23Jan2012. This is a Hinglish word in its origin but now recognized in English'

It could have been better for you to put your own circumstance for our consideration that you can or can not be!

Its rare of the rarest relief if one does not get it preponed on the same very date on which the date was fixed and parties and advocates were available.

But if other side agrees it is not a tough job.Quite easy then.
