if cheque is returned by the bank on the ground of account close of giving party then it can be the matter of 138 or not then which section is covered by this matter. thx

It is a fit case u/s 138. As per the supreme court, in the event of account closed, the cheque bounces for insufficient of funds only, because the drawer had withdrawn all the money from the account.

Issue the notice and file the case.
