mistaken creditto account withdrawn

A mistaken credit has been made in an account. the account holder has withdrawn the amount wrongly credited and is not ready to repay. The introducer has also not been coperating. What action lies against such pesrson through police?Please help/advise so that money could be recovered immediately.

Suit for recovery of money, cheating or criminal breach of trust could be filed.

Whether you have wrongly credited to another account or it is mistake of the bank. If it is your mistake then follow the advise given by Barman and if it is bank's mistake then approach the bank manager to correct it, if they didn't then file consumer complaint.

Legally no action can be initiated through the police. Only civil remedy is available.

No criminal case be initiated by the bank. The customer who lost the money can file a consumer case. But, the bank will credit the money on receiving the notice itself.
It is upto them to recover it or not.

Mr.Anonymous, what is your role in the querry. If you are receiver of funds due to wrong credit by the Bank, better you return the money to the Bank at the earliest.
If you are introducer to the account wherein the funds are landed wrongly and withdrawn, you please prevail over the account holder and see that the money is returned to the Bank. If you are a banker who has committed this mistake, you do not have any option except to pursue the matter with the account holder, introducer and their known friends through your customers to rectify your mistake.
Now coming to the point, the account holder who received such wrong credits, if withdrawn and used unintentionally, he can take time to repay the money as he is not true owner, but erroneously utilized the money. If the money is utilised knowingly,
he may have to face the crminal action that might be contemplated by the Bank. Banking based on trust. Being a customer of the Bank, the receiver should not breach the trust reposed by the Bank in him.
