DOWRY HARASSEMENT by HUSBAND AND INLAWS
Im the victim of the ill treatment , torture by my husband and his family.I need justice , i was treated very ill physically as well mentally by my husband and his family finally pushed in to sucide attempt due to mental torture by my husband and mother in law. Date of marriage : 18 : 01 : 2013 Place of marriage : Chennai Grooms Home town : Coimbatore My marriage is unconsumated marriage , the Day 1 of marriage was threatened by my mother in law and she demanding dowry to get consumated by her son. Days passed on the very third day of my marriage went to groom's home town for the reception held in coimbatore , on the same night my mother in law threatened me to give dowry else will not be allowed to live with my son in case if i give up and darely come to her home without dowry will be murdered by leaking Gas naming it as "GAS ACCIDENT" and will not let me live with my husband untill i satisfy her with the money.from that day was so panic to go to groom 's city and home didnt reveal this to my family .Days passed , my husband used to come to my home town on weekends during his arrival he used to get many phone calls from his mom and get warned not to touch me or not to be intimacy with me , hence he start torture me by suspecting and using abuse words , drink and hit me badly . When his cruelity been asked by my family members he used to threat will post my pictures on internet and the torture has no end days went with troubles and misery during september 30 i attempted sucide due to his mental torture and when i called them , they were treating me ill and said we are expecting the same die else my son will kill you lots of murder threat by him so i stoped going to job too. Faced lot of problems and troubles finally lodged complaint on october 7th 2013 AWPS near by my city of residence , FIR NOT FILED as per the 498A they told this case will be moved to DSWO and need evidence etc and mean while my husband is trying for ANTICIPATORY BAIL im so worried why this INDIAN LAWS ARE AGAINST GENIUNE CASES too ?? WILL I GET JUSTICE WHEN THE ACCUSED AND ACCUSED FAMILY ARE TREATED LIKE VIPs in the police station and DSWO.

Dear Sudhir kumar ,
Thanks for your valuable response , i lodged complaint against my husband and mother in law on 7 october 2013 , the accused : my husband and my mother in law are coming next week to give the STATEMENT or CSR with the criminal lawyer on their side . and this process goes to DEPARTMENT OF SOCIAL WELFARE OFFICERS : DOWRY PROHIBITION OFFICERS (DPO) between this period these people may get AB for sure mean while this process goesy like anything as per police advise i need to prove by providing evidence for dowry harasment as far as this family concern i cant be always with the witness , my in law asked and did all these inside the family , even for geniune cases if they do like this . How do the woman get justice for the realaccused.
As per your advise do i need to wait till the DPO (dowry prohibition officers) call us for enquiry??? and he will not be filed FIR and roam happily to get AB ??.
IS there any way to get filed FIR atleast for the cruelty happned to me on dowry issue.
please advise. He (my husband and inlaws) coming with leading criminal lawyer to the AWPS to give statement on 14 october 2013 . Can you guide me how to deal this so that it can be possible to file FIR on them

In addition to the complaint you filed for registering FIR under Section 498-A, 406 IPC and also u/s 3 & 4 of Dowry Prohibition Act, you can engage an advocate and file a case directly in the concerned Metropolitan Magistrate Court under Domestic violence Act. You should not worry whether they get anticipatory bail or later on regular bail, as these are discretionary in nature and not part of punishment. As per Indian law, a person will be put behind the bars before conviction for the sole reason that he will not hamper the investigation. Your insistence that they should be put behind the bars before conviction is unwarranted.

Dear Chandrasekar ,
The AWPS Inspector , told me clearly that they wont file FIR will get CSR from the husband and family and then send it to social welfare , as general public and victim these days money plays key role if the accused and family make ready opposing CSR and trying to escape how do i handle this

Then you have to file a private criminal complaint under Section 498-A, 406 IPC and S.3/4 D.P. Act before the first class magistrate under Section 200 of Cr.P.C. along with Section 156(3)Cr.P.C. application by engaging an advocate and you will get relief.

Latest amendment of criminal law provides in IPC by Criminal Law Amendment Act,2013, some provisions for filing direct complaint before magistrate against defaulting officers if they do not carry out duty as per direction of law and police can be prosecuted directly if he refuses FIR in dowry and sexual harassment cases, even victim woman need not go police station to answer police any queries.
