There is no word "accused' in DV Act so there is no need to appear in person. Opposite party is referred as Respondent which can be represented through his counsel.

Post the facts of your case. Usually appearance of the respondent is must in dv case unless his absense is condone by the court, or dispensed by court.

when an application is made under section 12 of act the magistarte issues notice to parties whose presence is absolutely necessary on date mentioned in said notice . the said parties are not accused . when any of the respondents desire to be exempt from personal appearnce they can amake an application to court and magistarte should consider case sympathetically
