Owning Adivasi Land in Maharashtra.

Respected Sir, My name is Abhishek. I have one query is that if a Adivasi from Rajasthanani bhil wants to buy adivasi land in Maharashtra so what is the procedure and documents required, and legal process?

Local Rules / law applicable, discuss with local lawyer of the place you want to purchase.

Use RTI to get information from collector office.

First sincere apology that I can not ans your query perfectly but some vague ans myself will try to give

Adiwasi in Maharashtra sell land they can do to only adiwasi , additionally recent amendment in land revenue code have transferred rights to subordinate initially it was with collector , additional my memory suggest last year amendment require permission of local Panchayat then file moves to thasildar for clearance.

In Maharashtra adiwasi get some certificate from thesil or circle or talathi level that person is adiwasi as per Maharashtra government resolution etc.

First without getting that certificate second getting clearance from local govt plus thasildar you purchasing land will be risky

Please note Maharashtra have strict rule special sec. Land revenue code is there which state any transfer to non adiwasi till 2034 , if noticed any time till 2034 govt can take that land and allot to other adiwasi or relative if adiwasi who sold land

So wise people who are not Maharashtra adiwasi even don't look at such land as till 2034 it can be taken back anytime

Politicians have constructed bungalows in adiwasi land on hill this is fact additional fact is that in some area mass sealing and attachments of property who are not adiwasi has also taken place this is reality

My personal opinion don't look at adiwasi land if you are non Maharashtra adiwasi

Maharashtra private forest acquisition act is also applicable.

CONTRARY to view of "Madhu":

1. Adivasi (Tribal) Land, is NOT "saleable" even to another Adivasi or anybody. The "local Panchayat", has absolutely no jurisdiction, whatsoever, on Adivasi (Tribal) Land, since "Adivasi (Tribal) Land" is vested with the Revenue Dept.

2. IRRESPECTIVE of any criteria, the Title-Ownership of Adivasi (Tribal) Land, is vested with the "Revenue Dept." of the State /Central Govt. and NOT with the Adivasi.
