Continuous adjournments since filing of case

My father has made an irrevocable settlement deed in my favour. An unknown person has filed a partition suit against me, with a false claim on my father's self acquired property. The case is still pending in the City Civil Court for nearly five years, WITH THE PETITIONER GOING IN FOR ONLY ADJOURNMENTS, AND SEEKING RANSOM as a condition for withdrawal of filed case. Can any of the expert legal counsels provide me with a solution?

Apply to the same court to expedite the matter with the help of your lawyer.

If there are so many unnecessary adjournments then file Writ in High Court, if matter is with Civil Judge Junior Division then file application before District Judge or Sr. Division for directing Court for expeditious hearing due to unnecessary adjournments. Speedy disposal of cases is also an constitutional right as held in Hussain Khatoon Vs. State of Bihar. You will have to continuously and consistently without any mistake have to peruse the matter to avoid adjournments.

How come partition suit of an "Unknown" person admitted and proceeded for the last five years.
