Child visitation

i left my home 6 months back after a lot of fights and torture from wife. My 3 years old son is with her.
she has also filed 498a against me. we have filed quash in high court. no other cases filed by her yet.
i also do not wnat to initiate any separation and divorce proceedings right now.

she has not allowed me to meet my son. can i file only for visitation rights in family court without initiating any separation or divorce proceedings.

You have to file a custody suit u/s 25 of Guardian and Wards act in which the court will grant interim visitation rights in the meantime.
If there is any matrimonial suit pending therein also you cans eek similar relief.

When your wife has already allowed you for meeting your son and even she has not filed other cases (you also do not want) then why to file petition seeking visitation rights?

You have legal right but if your right even without any court order is being provided to you, accept it as a gesture and good luck.
