Car parking is the right of owner without allotment or purchase from land lord in residential apartm

In residential apartment, we are the one of owner of the aparment and parking the four wheeler last 20 years. WE HAVE CAME OUT AND GIVEN TO HOUSE ON RENT. In our Existing owners objecting the carparking area by tenants. Please give in this regard

From the facts disclosed, right to parking has been a common right. Your tenant is entitled for that right. Other owners have no right to object or interfere.

Whether the document allows you car parking rights? If so, you tenant can step into your shoes and use it. If you do not have legal right, you can not pass it to your tenant. Allowing you to park the vehicle for last 20 years without rights is a different matter.

Are you paying non occupancy charges to society?
If yes, then they have no right to obstruct your tenant.

If bye laws of the society does not put such restrictions specifically, tenant can park his vehicle if land lord was already parking.

If you have right of car parking in the premises than your land lord and or other person has no right to arise any question regarding the parking.

I agree with most of the learned advocates here. The tenant has all the rights to use the parking as the landlord. The Society, if it is, has to issue the notice to that effect citing the reasons of such interference.

If bye-laws of the society do permit, tenant can park his vehicle inside the premises otherwise he has got no right to do so.
