Generally, once property is gifted, it cannot be revoked by the donor. However, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, parents who have gifted property to their children can seek its return if the children fail to provide basic amenities and support. This is considered a transfer made under fraud or coercion, and the parent can petition a tribunal to declare the gift void. Recent court cases have upheld parents' rights to reclaim gifted property under these circumstances, especially if the neglect occurs after the Act came into force.
