Hello
A flat is jointly owned by father and daughter, and both their names are reflecting in the sales deed, sales agreement and in the share certificate. The family consists of son and a daughter (mother passed away long ago). Recently father passed away and left a clear registered WILL that after his demise, all his rights of this flat including the shares should go only to the daughter and nothing to his son since he had already given another flat and more to settled the son. And there's no nomination left by the Father. The very fact the daughter's name is the 2nd name in the share certificate, she already holds 50% of the property. Is it not the right for the daughter to demand the society to delete father's name, amend the records accordingly and request the society bills on her name? Kindly share your expert views in such a situation - what the bye laws says and what needs to be done by the daughter and what society should do to make this change. Thanks

The respected senior experts
Sir
In case of agreement between our company and outsider, Arbitration Clause was normally inserted to settle any dispute.
Board of our company takes a decision that instead of going for settlement by Arbitration the company have to approach to the civil court . So in future there will be no Arbitration Clause.
I drafted the undermentioned clause which may be inserted in place of Arbitration Clause.
Now my query before the honourable senior experts that is the undermentioned clause is sufficient to refer any dispute before any Court of Kolkata including money Suit?
“ALL DISPUTES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT SHALL BE DEEMED TO HAVE ARISEN IN KOLKATA AND ONLY COURTS IN KOLKATA SHALL HAVE JURISDICTION TO DETERMINE THE SAME.”

Respected Experts,
In the year 2016 I filed Application u/s. 340 of Cr. p. c. before the Appellate Bench of Court of Small Causes Bandra which heard last 25 days and the Court passed Order saying that the said Application will be heard along with Appeal and matter adjourned for hearing of Appeal. Thus the Appellate Court refused to initiate preliminary inquiry u/s. 340 of Cr. p. c. I want to file Appeal under Section 341 of Cr. p. c.
Kindly inform me (1) Which is the Appellate Court (2) Whether to file Writ Petition before the Hon'ble Bombay High Court (3) Whether Appeal under Section 341 of Cr. p. c. lies in the Appellate Side of the Hon'ble Bombay High Court ?
Thanking You,
Sadanand B. Panchal
