contract issues

This is with regards to a contract employment-- we 2 employees employed on a contract by an indian contractor but working for an MNC from the past 25 & 12 years respectively.. Off late we are having a lot of issues with our contract..It has not been renewed from the past six months but we have been receiving salary.. Now they tried taking one employee out but was not able to do as is surfaced the contract documentation was inappropriate.. Now they have been asked by the MNC to close this contract and put us in the indian pay role.. The contractor wants us to sign a document of acceptance on the same.. They will pay us us PF accumulated and gratuity.. they want us to wipe the years of service we have put in.. and start fresh in the new company , but we are reluctant as we know we wont be in that employment for more than 6 months as then they have a right to check us out.. Secondly can we claim retrenchment compensation due to closure of the old contract or any way to account for the years we have put it...

Request an urgent response as this will have to be closed by next month

Non Joinder of necessary parties in partition suit.

Respected Seniors,

In a Partition suit, in the plaint some of the necessary parties to the suit are not added as parties by the PLintiffs.

Then the defendants taken a defence in their written statement about the non joinder of necessary parties to the suit.

Then Hon'ble Court framed issues exect the non joinder of necessary parties. Immediately the Defendants filed a petition to frame as issue about non joinder of necessary parties to the suit and the said petition was allowed by the Court.

In this case I am appearing for defendants.

In the above circustances is there any chance to dismiss the suit without conducting trial by Hon'Court since the plaintiffs are intentionally not mentioned their own family members as necessary parties to the suit?

Divorce under Hindu Marriage Act, 1955

One marriage has been solemnised on 16th January, 2009 under Hindu Marriage Act, 1955. After two-three days from that marriage day the bride came back to her father's house and said there is some mental mis-match between she and her hesband and she don't want to go back her marital house. The marriage is not yet been regigtered under any Act, only socal marriage has been done. she wants divorce. Now in that setuation my question is as follows:-
1) The marriage is not yet been regigtered under any Act. so is it necessery to take divorce from the Court?
2) If it is necessery then how much time she have to wait for divorce?
3) What is the procedure to make this divorce if it is not done by mutual consent?

To get back wrongly alloted properties..

A Sunni hanafi Family partition suit is decreed. As per decree male is entitle for 2/17th share and female is entitle for 1/17th share in the property. Decree consisted of two types of properties town properties and revenue lands.

Final decree proceedings filed in 1989 to execute the decree, the town properties were divided as per decree and part of final decree proceedings for town properties is completed in 1996,

Some LR’s of one of the plaintiff who are not entitle for share has been jointly allotted properties in town along with other heirs of plaintiff,

Now execution is pending for town properties, and other part of same final decree proceedings for revenue lands is still pending.

Now we have file and IA in pending final decree proceedings to strike out LR”s who are not entitle for share,

we also want to get back the town properties allotted in 1996 to those LR’s who are not entitle for share.

Whether we have to file a separate suit or we have to raise this issue in the pending execution or we can raise this issue in pending final decree proceedings for revenue lands.
