Motor Accidents Claims Tribunal

Injured victim filed a claim petition against the owner, driver and the insurance company of the vehicle.

On first hearing insurance company filed vakalath. driver was set exparte. Fresh summons was ordered to the owner. But steps not taken.

On subsequent hearings, since counter was not filed, insurance company was set exparte and since steps was not taken, claim against owner was dismissed.

Now matter posted for exparte evidence of the petitioner. How and from whom can the petitioner get his remedy?

hello, everbody and thank u very much for your reply. i have another question for our readers, during the trial of case a witnesses is making statements and changing his statement now and then. can the hon'ble court take a note of the change of statements by the witnesses which is contrary to the facts of the case. can the court take notice of the deminors in his statement.

Credit Card- Loan

'A' - a credit card company offers loan to 'B' a software engineer. Before sanctioning of loan amount, A send a statement of balance statement for which B have to pay first month due.

No details of Sanctioning, employees of A saying that Loan was sanctioned and cheque sent through courier. But on further enquiry A said that cheque returned as no such person in the said address.

But next month B receives another balance statement to pay next month due. On telephonic inquiry, B was not satisfied as employees of A admit the payment of dues by B but whenever A calls of Loan sanctioning, employees saying "Loan under processing".

What is the remedy for B

cheque bouncing

dear sir

against export order i gave a company advance payment of rs 11 lacs.this company failed to give me the goods at the agreed delivery schedule.this resulted in my order getting cancelled.i asked for refund of my advance payment the company gave me cheque which bounced on presentation due to insufficient funds.
What i have to do next to recover my money from this company and how much time it will take in courts

locus standi of private person

under secs. 203,170 & 265 rajasthan municipallities act, 1959 private person have locus standi for complant against any person?

Mortgage Deed

I am applying loan to one Bank, Bank has sanctioned the Loan, but after Registered Mortgage deed. But I request to the bank for Equitable Mortgage Deed. Can I submit Equitable Mortgage deed to the bank, if yes suggest me provision. thanks

Land laws... agricultural land

Dear All,

Kindly suggest me on the following:

'A' is an owner of an agriculture land. His younger brother 'B' is using that land since more than 40 yrs. 'B' is enjoing the income out of farming. He has put tube-well for the farming purpose.
It was actually transfered to 'B' oraly by his father but nothng was taken in written.
Now as 'B' has been using and earning out of it since more than 40 yrs can we say that the said piece of land has become B's property.
Does limitation act applies in this case.

Hi!
I live in a flate with my parents & Uncle. After my grandfather expired, my grandmother is not disclosing any information regarding the will made by him. I am afraid she will give away the flat to my uncle, if it is under her name. I wish to know

(1) What can I do to get my parents his portion in the flat in case it is Sold?

(3) Can I legally ask her to show the will?

(2) Can she give away flat to my uncle?

(3) Are there any legal actions I can take since I have been staying here for the last 26 years to get my parents right?

(4) Can I Nominate my fathers & uncles name as joint nominee with the society without my grandmonthers approval, since she would like to add only my uncles name?

(5)Also I heard from a friend that even if my father is not given any portion, I can get my portion by law, since I have been staying here since birth, Is it true?
