Seniority protection under technical resignation

sir,
i had joined Chennai customs (CBIC) as an examiner (GP 4600) on 31.01.2013. I applied for technical resignation and joined mumbai customs (CBIC) on the same post i.e. examiner at the same grade pay (GP 4600) on 01.09.2014. I had cleared departmental exams for confirmation/promotion in chennai in august 2013. probation period is 2 years for the post of examiner.
my question
1. can i avail seniority benefit for promotion in mumbai.
2. as per the dopt o.m. dated 27.08.2018, does the post/appointment held by me come under substantive post
3. can i appeal to dopt

Vehicle parking in front of my shop

Respected experts,
I run a small shop on a road facing, within 100meters from my shop there is an alcohol shop, people park their vehicle in front of my shop and go to purchase alcohols and also sometimes they restrain my way which causes me problems to run my business.
1. How can I seek help from the police?
2. Can I click a picture of those cars and file an FIR against them when they use dominance power against me.

Reopened - revision

My complaint FIR (420, 406, 506(2) ) was closed in magistrate court as mistake of facts. As a PIP, through HC - Revision Petition, I have reopened and judgement delivered. And directed the magiatrate for proceeding the case. But no action was taken by Magistrate and police as well. Kindly direct what should be done for remanding the accused?

Some legal query regarding rent.

Hello Sir/mam,

I have to give one property on rent.
I have some legal queries.

1) If any Tenant do illegal possession by Force (KABJA), Then can the owner of the property file the complaint in police and take help of police to make them vacate the Land without going to court?
or
2) If KABJA Happens on property then owner can only move to court and fight a case wjich takes many years and cannot go to police.

Which one is true, 1 or 2 point?

Please clarify?

Lis pendens removal

Dear Experts,
We have made agreement to sell an agriculture land in the year 2011 and agreement was clearly stated with cancellation clause. Later on in the year 2013 due to dispute, purchaser had filed suit for specific performance on us. He had also filed lis pendens in 2013 with sub registrar. In the year 2017 Lower Court ordered in favor of us and cancelled the agreement to sell and also ordered to return Earnest money ( with 6 percent interest) to Purchaser. We have made appeal in High Court against the order for not returning the money. The case is pending in high court. Purchaser whose intention to damage property title, has never demanded for money and filed any execution petition with respect to lower court order. He also don't want to accept money as per lower court order.
Now we want to sell our property and want to remove lis pendens entry in Revenue Documents. What Should and How it can be Done?

Poa for a land to be registered in tamil nadu

Dear Sir/Mam!
I live in Tiruchirapalli, a city in Tamilnadu. My sister is living in Gandhinagar, Gujarat
She has a land property in Tiruchirapalli......we were trying to sell this land for past 4 years,but could not find a buyer.
I found one buyer who is interested in purchasing this land now.
But due to this Covid situation she is unable to travel to execute the sale.
So we thought that she will make a POA in my name and I will do the sale process
Can you please suggest some lawyer who can assist my sister in doing this POA in Gandhinagar and send it to me so that I can sell her land ?
May we please know the procedure for doing this POA in Gandhinagar, Gujarat?

Leakage in flat

I have received possession of my flat in Oct 2018, earlier it scheduled in Sept.18 but they postponed possession to October due dampness in the bedroom ceiling.
we are facing leakage issue in my flat since july 19. We raised this complaint to the facility management appointed by the builder. They have resolved this issue in 2019 after rainy season (after 122 days from the date of complaint raised) and informed us that issue is resolved but I had doubt on their work, So We have clearly mentioned on their complaint closure report that we can not check the effectiveness of the work done by you but they have closed our complained in their system.
Now this year also we are facing leakage issue in the same areas and some other areas as well and we have raised this complaint before 30 days but we have not received any response. We are also sending emails to the customer service portal of the builder but they are saying that you need to contact contact to facility management appointed by builder. So no one is resolving the issue.
In fact my possession of flat was postponed by builder from sept 18 to Oct 18 by given reason of dampness in sealing. Now I have doubt that they have handed over me this flat (in winter season) without resolving the issue. They have cheated with me by delaying my possession from rainy season to winter season to hide this issue of ceiling leakage. I have all evidences with me..
So I need expert opinion how to deal this issue..

Offence u/s 498 of ipc

Respected Sir pls advise ...........


If Wife and Husband are not citizen of India (they are citizen of other country) but marriage occurred in India in 2008. They left Indian in the year 2012.

Mother in law and father in law of wife are staying in India

Wife has lodged FIR offence u/S 498 of IPC against husband, mother in law and father in law in India.

Mother in law and father in law got Anticipatory Bail.

Now father in law (father of husband) is not well and hospitalized and son (husband ) wants to come to India to meet father but he is apprehend of arrest by the Police.

1. What is legal remedy to husband (son) who is not citizen of India to come to India to meet father.
2. Whether Indian court has jurisdiction against a person who is not citizen of India.
3. Whether Police has jurisdiction to lodge FIR against person who is not citizen of India.

Both husband and wife are not citizen of India.

What is legal remedy for husband to visit his father in India.

Please advise...............
