Patta transfer

Dear Experts,

My father and mother owned a company from 1988 as partners. My father died in 2011 and now we have executed a amendment deed and I am the Managing partner replacing my dad and my mom is the partner.

The patta is in my fathers name along with company name as "Company name - managing partner - my dad's name". Dad's legal hiers are me my mom and my sister. My mom and my sister are willing to transfer the patta in my name. What is the procedure to transfer the patta to my name?

Regards,
Deepakumar

Please help ! my company forcing me to serve full notice period !

Dear All,

I am currently employed with a Bangalore based third party organization, working on client side (MNC) in Greater Noida.
I am working in IT operations as an Application Support Executive and I am the only girl in my whole team. The work environment is not so good here and few senior team members behaves very rudely with me.
So, I decided to move on from here and luckily I have been selected in some other organization.

The issue now is that my official notice period is 2 months but the new organization has given my joining date of 1 month.
So, I have given resignation in my current company for 1 month and I am ready to buy out/pay for rest of 1 month.

Below is the snippet of section of "Services and Termination" in my offer letter:
"YOUR SERVICES CAN BE TERMINATED BY EITHER PARTY BY GIVING TO THE OTHER, A NOTICE OF TWO MONTHS IN WRITING. THE COMPANY HOWEVER, RESERVES ITS RIGHT TO TERMINATE YOUR EMPLOYMENT BY GIVING YOU SALARY OF TWOM MONTHS IN LIEU OF NOTICE. THE COMPANY RESERVES ITS RECOVER AN AMOUNT EQUIVALENT TO TWO MONTH'S SALARY ON PRO-RATA BASIS IF YOU FAIL TO GIVE TO THE COMPANY, ADEQUATE NOTICE OF YOUR ATTENTION TO TERMINATE YOUR EMPLOYMENT."

But the HR is refusing to relieve me in one month, as they need a resignation acceptance mail from my client side reporting manager, and their reply on my resignation mail is as follows:
"As discussed, we cannot relieve you on short Notice.
Your have been appointed and placed at an important position at the Client’s Project end, which needs proper Notice for Knowledge transfer.
Also, Notice Period Buyout acceptance is completely dependent on Employer’s discretion.
These things get considered by Employer only in few extreme situations and after due diligence of Floor Operations only.".

QUESTION: Is it really the case that I cannot leave my current organization before my notice period even if I am ready to pay for 1 month ?

Please advise me how to proceed as I need the relieving letter from current company.

Regards
Parul Gupta

He made my life like a hell!

Dear Sir/Madam,
I'm Maahi from Delhi, 25 years old. At the early age of 17 my parents forcefully arranged my marriage with 30 years old man who is not too much educated and I have a son who is now 7 years old. From the very first day of my married life to till today I'm just living like hell. He torchers me often with stick, bat and even with belt. He tries to make physical relation against my permission and uses to give me drugs for that. He always ask me to bring money from my parents if I refuse he run away from home for two to three months after leaving me and my son alone. The most shocking thing is my parents never support me because they are villager and have very typical old thinking and always say, it's your life and destiny, we can do nothing, you have to face, you have to bear it. Sometime I doubt he has a second wife and child.
Two days before at night my husband fought with hit me with belt and next morning ran away again with all money of home and till now I don't know where is he.
Now I don't have money to cook food, I have to pay 2 months rent, I have to pay 3 months fees of my son. I'm not getting what to do? Where to go? Whom to say? Just want to leave this world.

Vakalatnama

Dear Sir/ Madam,

My mother-in-law is a retired Bihar state govt employee. Many of her colleagues want to petition in the Supreme Court for their pension fixation on 6th pay commission. They asked her to sign a Vakalatnama and send it to them.

I wanted to know - whether sending a signed copy of Vakalatnama on an A4 sheet will be okay or we need to get a non-judicial stamp (and what amount) notarised with her signatures on it for sending this Vakalatnama. We are currently in Bangalore.

Thanks!
GS

Legal status of me in a messed up family?!?

Hi All...

I am seeking a prompt answer for my legal status in the family as a step-son.

My mother had divorced my father in 1987. She got remarried to a person who's wife was died and he had 3 children in his first marriage. Then i was 4 years old. At that time he gave a word to my mother's parents(they are still alive) as well as to my mother that he would take care of me like his own son. Based on that she married that person. From that day i am staying with that family where my mother got remarried. Now its been 26 years. My Mother and that person together has a daughter. so we are 5 children in total. He brought me up as his own child in front of the society? Now his children are creating so many issues against me.

Q: 1) If i file a case will i be able to obtain a title of an adopted child? How this relation is defined? What is my legal status in that family?

2) Am i his step-son or adopted son or Is he just my local guardian? If i fall in any of this 3 category then what all privileges i have in that family? Do i have all the rights in everything as the other children have in that family?

After 26 years if his daughters are asking me to go away from that home what else can i do rather going for a legal opinion. Where will i go now? Who will be there for me?. I cannot go to my biological father because i haven't met him since years.

Being a step son do i have any rights on his succession (like property or carry his lineal heir)? He don't have his own son alive, he passed away 4 years back. So i am the only male child now. I am not able to find any relevant cases of this kind or not able to find any supporting law in hindu succession act. If there is any case laws or LAW kindly quote.

I am not here for any kind of arguments. I just need to know my rights!

Thanks in advance

Richi
