Land purchased but not registered

sir my grandmother purchased some land in 1976 but did'nt got it registered but the seller gave in written on a 5 rupee stamp paper that he has sold it and will register it when ever the owner say ,now in 2014 the man who sold is dead but his son is claiming the peice of land and want it back and is not allowing to do any repairation work also. the land is under our possesion from 1976 there is a house built on it and we live in it. is there any chance that he can aquire our house. please reply how can get it registered on my name.

Notice to appear on 4th saturday (holiday)

Respected Sir,
I have received a notice (Notice to informant) stating to file objection if any on a final report submitted by P.S. I field an FIR against some people and against the P.S. for lodging false 498A case and for pressuring us by Police to withdraw case lodged at Police Accountability Commission, Police phoned my wife and said 'u withdraw the accountability case then we will favour u by not lodging the 498a case'. therefore I wrote challenging the police to send me and my family behind bar if we have done any wrong if not than lodge a case against those people who have lodge false case sine there are provision u/s 182, 211 R/W 511. in this regard the PS has filed FR but I don't want to let it go without reasonable conclusion.

Now problem is that the appearing date is on 4th Saturday i.e. on 27/12/14 my lawyer is bed ridden for diabetes, today I went to the court the Clark told me to come on 29/12/14 and to submit a petition. My confusion is what petition is to submit, should I mention about the notice served to me to appear on holiday, how the petition is to be please guide.

Caste certificate

sir my family belong to sc category from punjab but my family was migrated to maharashtra in 1976. i wanted to obtain sc certificate for central purpose ,so sir can you please tell me from where i can get the caste certificate. i was born in maharashtra .and my cast is not listed in maharashtra state.

Is it must for the NBFC to go for the EP from civil court,after the arbitration award is passed in their favor before towing away the vehicle financed? During this EP in civil court,does the borrower gets a chance to put his say and to defend himself? Can NBFC tow away the vehicle forcibly,purely on the basis of this arbitration award passed unilaterally, without the knowledge to the borrower and without the copy of that award to the borrower and that is also without the EP in civil court for that arbitration award?The police try to give this case a civil look.Is it not a criminal matter to tow away ones vehicle forcibly without informing him?The police are not keen to book the NBFC employees under the criminal sections of theft.In such situation what are the remedies left for the borrower? There is a dispute between borrower and the nbfc over the discrepancies and modifications made in the loan agreement in the absence of the borrower without his knowledge.

Querying for purchase of part property.

Dear Sir/Ma'am,

I want to purchase a part property (Duplex, size: 15x40), which was build with another duplex on a single plot (size: 30x40). I am taking loan for the same. The Loan officer asked the mother registry (which is the registry of the plot). The person from which I am taking duplex, have registry of duplex only not mother registry. Now the condition is:

1) The builder who sold both duplex saying he doesn't remember to whom he gave the mother registry.
2) The Owner of other duplex may be having mother registry but he is not giving/showing to me. (He says, "I owed 11,000/- to the builder, first you help me to take the money back then I will give registry to you. But when I agreed to give money he said I want 22,000/- now.")

My question to you is:
1) Can there be any problem in future because of that mother registry.
2) And when somebody has sold out a home (made as/on part property). After that home registry should be counted. Or in any case plot registry also has any role in any legal issue.

Transfer of flat being oppsed by members of society

I had purchased a flat in Andheri from Builder directly after the formation of society.(It was builder's unsold flat)

Sale deed was registered and all transaction has been through.We have OC copy, Registered sale deed and posession letter.We are currently staying in the said flat.

However Society has refused to transfer the flat in our name as it has to settle some scores with the builder. Builder had taken advance maintenance from few people and have not returned them . Builder says he to get dues from other people of the society and hence there has to be full settlement. This settlement of funds from builder and society is going on since last 2 yrs. Society people are frustrated with it and they are now opposing transfer of our flat into society and they ask us to put pressure on the builder to clear settlements so that we transfer your flat to society.

My question:
It this fair at all?

Are we (buyers) at any kind of fault here?
Why we have to suffer for issues builder has with society and its members?
Is there any law which stops us from getting the flat transferred into society?
Can this be opposed at all?
Isn't it that unsold flat purchased directly from Builder after formation of society becomes part of soc. after paying the charges?

Please provide some advice as the settlement with builder might go on for years or decades to come. Society people are not interested in transferring property as they want builder to clear the dues.

a: We were provided NOC by the society (No dues certificate) while purchasing the flat.
b: They do not allow us to put the name plate at the entrance of the building.
c: We are 1st buyers of the said flat

Adhoc bonus eligibility

Learned Experts,

I am working in Navodaya Vidyalaya Samiti (an autonomous organisation fully funded by Central Government) as a Post-graduate Teacher and my initial Grade Pay is Rs.4800/-. Now, upon grant of ACP, my Grade Pay is Rs.5400/-. I am not a Gazetted officer.

As per Finance Ministry’s OM regarding Adhoc bonus, Central Govt employees in Group ‘C’ & ‘D’ and all non-gazetted employees in Group ‘B’ are eligible to get Adhoc Bonus. However, I am not granted Adhoc Bonus this year. On enquiry made through RTI, it was informed that “NVS employees are governed by NVS Rules/guidelines and those employees who are drawing Grade Pay of Rs.5400/- and above are not eligible for Adhoc Bonus”. Based on this contention, even NVS Group ‘C’ employees like driver, staff nurse, TGTs etc are not given Adhoc Bonus. Whereas NVS always states that it follows CCS/CCA of Central Government in full regarding service matters and even financial matters.

Kindly clarify whether autonomous bodies like NVS/KVS can make or formulate their own rules regarding adhoc bonus. In KVS, (Kendriya Vidyalaya Sanagathan, a similar autonomous organisation like NVS ) Post-graduate Teachers who are drawing Grade Pay of Rs.5400/- are given Adhoc Bonus. Kindly clarify the stand of NVS regarding the grant of adhoc bonus. Is it correct to deny our right to get Adhoc Bonus? Can I approach the Samiti legally to get this Bonus?

Pata- for creation of equitable mortgage.

Can we consider PATTA as title deed for creation of equitable mortgage.
In my view it is only evidence of title and not title deed,which is basic requisite for creation of equitable mortgage.
