Gratuity

Hello Sir / Madam,

I have served a IT / ITES based company in Tamilnadu - Coimbatore for a period starting from March 2008 till Nov 2014. My resignation was accepted and was relieved from duty on November 2014 with a small farewell party hosted by the management. The company provided me the salary certificate, relieving order and experience certificate duly at the last working day with the company.

When I was relieved from duties, our HR department stated that they will pay my Gratuity amount after 30 days of my last working day with the company, which did not happened. I waited for 40 days and started following up with the HR department for the release of my Gratuity. Initially HR stated that our CEO needs to work with the company auditor regarding the gratuity of mine and i was waiting few more days, however got a response from HR stating that the CEO of the company is contemplating the forfeit of my Gratuity.

I was completely shocked and requested for a meeting with the CEO which happened recently and during the meeting CEO was claiming that they cannot release the full Gratuity and laid the reasons below:

1. During my employment with the company, in the year 2013 the management had to process a refund to a particular international client, for whom the company was offering support services. I was managing the support team at that time. CEO stated that the refund was processed mainly because of my negligence of work.

2. CEO now states that my overall performance was not satisfactory all through my tenure with the company and am unfit to deliver matching the expectations of the company.

CEO stated that they can think of paying only a portion of Gratuity and the management will withheld the portion of my Gratuity and adjust for the losses.

Am really surprised to learn such comments right after i requested for my Gratuity.

Can you experts please advise on how i should proceed further and what should i need to do at this juncture.

Criminal appeal/revision against dismissal of appeal in default

sir, a criminal appeal against acquittal is dismissed in default by the ADJ in session. can one file revision or appeal(in high court) under what section of crpc against this order ? what is the limitation period for that? if this revision/ appeal proved to gain ulterior motive/ counter attack than what?

Change of income tax jurisdiction of unlisted public limited co.

An unlisted public limited company has its registered office at Kolkata. Its tax jurisdiction is also Kolkata. Now, the company wants to change its tax jurisdiction from Kolkata to Mumbai without changing its registered office address. Currently, the company has its administrative office at Mumbai. Can the company apply for change of tax jurisdiction from Kolkata to Mumbai based on its administrative office in Mumbai without changing its registered office from Kolkata?

at the end of the form it says

Signed, sealed, and delivered by
for and on behalf of the Governor of Uttar Pradesh


My Query is:

How to know or which law can tell that, at present who is the authorized person to sign this on behalf of Governor.

Change of children name without the knowledge of father


Respected Sir/Madam,
My wife has lost her memory completely, she is physically and mentally abnormal due to the side effect after outcome of suicide attempt (hanging herself). Now she is living with her parents. My in-laws filed a case against me u/s 498(A), case is under trail in court.
My twin girl childs (4 years) are with my in-laws. My in-laws has changed my children's name(differ from Birth Certificate) while admitting them to the school.
What can I do?

Petitioner appearing on date of hearing

I am an petitioner with my divorce case pending and next date of hearing in July 2015. I am planning to go overseas. Supposing I am not able to attend and nor my advocate only the next date in July 2015, please inform what happens in such situation.? Is the case closed by court for non attendance or is the next date given ? The respondent has already never appeared since overseas.

Ni act

Sir
1. I have filed the Affidavit of the complainant in lieu of chief examination in NI Act case. The affidavit was not signed on each page but signed at the end of verification, the court has recorded and defence counsel has crossed the complainant. Is the affidavit is a valid one?

2. In NI Act I have sent a regd post with ack due after the dishonour of the cheque., third party in the house of accused received the notice by signing the acknowledment. Is is valid?

Kindly give me clarification with citations if any.
