Cheating by the builder

I have booked one flat in under construction building in Mumbai and was issued allotment letter by the builder. Over a period of time i made full payment as per letter of allotment. I kept asking the builder to sign THE AGREEMENT FOR SALE and complete the registration process but he kept dilly dallying by giving one or other excuse.
I then sent a legal notice to builder to sign and register the agreement for sale and since he did not reply to the notice i filed a civil suit for direction to builder to sign the same. In reply to our motion he told the court in affidavit that he has sold the said flat to another person and created a third party interest.Since he stated that he has sold the flat to third party i filed a criminal complain for cheating against the builder with the police.The local police is not taking any action on my complain and verbally stating that since their civil suit is pending in this case no FIR for cheating can be lodged against the builder although i told them that it has become a case of cheating only after builder has stated selling the flat to third party and FIR should be lodged but police is not agreeing.

Can you please advise what is correct law in such matters and what should i do to get my FIR registered

Termination letters can be sent to employee via registered post or courier?

Hi Experts,

Need an urgent clarification on the termination letters which are sent by the HR department to the absconding employees. We are sending it via courier where we ensure to collect the POD copy as acknowledgement? Should we send via register post? does this have any legal impact? pLease advise.

Property dispute

sir

we r four brothers and one sister.we came to know that our ancestral property was sold by our cousins using forged documents in 1965.that property was bought by our grand father in 1933.we dont have any mother document or a any copy to support our claim.pls i need u r advice

Slum devlopment

sir, i am living in vileparle at prime location in a chawl.their are two owners claiming their rights on property and matter is in court.now we appointed a builder who will help us to devlop our property through Mhada by going into aquisition.he told us to make m.o.u.for further devlopement .so can you advise me what to do. is there is any option to approch Sra directly withought consent of disputed owners.

Stilt parking

I bought a stilt parking in the year 2006 from the builder at a premium rate. Builder gave me an allotment letter and has also mentioned the amount and the mode of payment, which was cash. Now i am selling my flat, so rightfully the buyer of the flat should get the parking which i bought from the builder. I want to know can i sell it to the buyer? If yes, what procedure should i follow?

Urgent capital gain query

Dear Taxperts and lawyers

Suppose if there is a flat which is for more than 3 yrs in the book of accounts later it was sold

Now it falls under Long term Capital Gains Later on I buy another flat (which settles previous flats gain but it is more costly therefore it is only booked for which allotment letter is given ) within one year

the flat is there in my book for 1 yrs and that the new flat bought is mentioned in IT return filing

but after 1 yr I am unable to pay the entire proceeds required to buy the new flat builder says he will sell it to other party and that allotment letter stands cancelled

My question is

1 What will be the Tax implication in such a situation

2 Will I continue to get d time frame 3 yrs from the sale of old flat

3 If I sell the new flat or surrender the new flat builder under distress and if there is no capital gain will i still be entitled to short term capital gain

Purchase a property through drt & bank auction

Dear Sir,

I want to purchase a property from Bank auction, as per auction tender document contain a statement "as is where is basis" what is meaning.

1. Can bank provide a clear title to me?
2. Can bank execute a sale deed in my favor?
3 .In a tendered document property tax and electricity charged brone by tenderer current as well as previous, Can sale tax, excise, service tax & any other tax liabilities on this property because defaulter company has taken this number?
4. what kind encumbrance on this property?

Salary not paid....torturing me

Dear Sirs,
Kindly request for your valuable suggestion.

I was working in of the xxx company in Hyderabad from past 8 months. The company did nt pay my July salary till now. I asked my July salary in August mid. The Hr answer me that he will give by end of August. On 31 August the Hr gave me termination letter and said based on your performance management terminated me. Hr said im terminated with out any notice as I am on probation. Actually my probation ended in june. He didn't made me permanent. Actually the fact is I am asking salary management decided to terminate me. Management said that the will settle my July salary by end of August and August salary after full and final settlement. But they didnt paid my July nor August salary till now. When I approached them they are saying they will not settle my salary . I can go where ever I Want.Kindly suggest me whether I should go to police station /Labor court? Should i need advocate to file a case on my company. Kindly tell me the procedure plz...

There is a land located in Delhi which is Nazul Land Supported by perpetual lease

Whether the bank or financial institution can take such nazul land as mortgage If yes whether there is any specific requirement for the same
What are the provison for conversion of Nazul Land to freehold
