Eligible for gratuity

I just want confrim that i have join a company on 8th of April 2008 and my last day of working was 15th of Dec 2012 that is 4 year ,8 month and 8 days including the end date. therefore as per judgement of honorable Supreme Court . Is am eligible for the gratuity as of now.

The payment of bonus act

What is the Calculation of Bonus of Employees getting salary more than 3500/- and less than 10000/-, because bonus of 3500/- can not be given equally to all as No. of working days of each employee shall differ. Should it be paid proportionate to his earned salary considering his salary as 3500/-

and ESI . To my knowledge P.F is 12% of salary . what is defination of salary.
and what is defination of salary for ESI.
Employer and employee contribution.
Please tellme in detail about those.

Stay on labour award

can a high court stay and award of the labour court till further proceedings with reinstating the workman and/or without compliance of the mandatory provisions of section 17-B and without deposition of huge amount.
the issue is pending since 4 years before the hon'ble high court .
what is its legal implications.

Salary

I am working with a reputed MNC on contract basis and getting salary 12000 PM, My senior executives getting 18000. 2 months ago company recruited 1 person on salary 16000 thousand (he is M TECH)Now company has recruited 1 more person on same 16000 package (he is BA) I am also a BA.
I am with the company by 2 years(almost).
If the work is same I don't know why there is a difference between the packages. I tried to ask my reporting manager but he refused to talk on this matter as its against company policy.

Workman has filed case in Labour Court against termination through unfair domestic enquiry & for violation of section 33(1). What is the process for withdrawal of some PF amount as he needs money & what is the limit for withdrawal.Pl respond.

Pf and super annuation withdrawal application


Please advise me for withdrawal process of my PF and SA from my previous company. What is the process formality and compliance required for withdrawal process. I have submitted withdrawal application for PF and SA in the format provided to me by my previous co. but the same have not been process by the company for 6 months time. Do I have any remedy to claim delay in process by my earlier company who are duty bound to process my application since I am no longer in employment at the moment at any company.

Gratuity

sir,
since last 2 years gratuity application is pending before controlling authority, management only taking adjournment ,
in that gratuity application i claimed gratuity should calculate on my last drawn consolidated salary for that i have submitted my last drawn salary certificates ,
Management is ready gratuity on basic and DA amount , but i was received consolidated amount only ,
i was not provided ESI, PF , HRA , and all , know for gratuity purpose management calculated basic and DA ,
how much i am entitle now
