Gratuity payment

1. Is it permissible under law if the amount of gratuity exceed from the ceiling limit of Rs. 10 Lakhs in a case where a persons has claimed gratuity from the different employers for the period he has worked?

OR
In other words the maximum limit of Rs 10 lakh is for entire service career or for each employment.

Suspension

My queries are:

1. can a suspended employee be asked to marked attendance daily?

2. if answer to first is no than what will the position if during the period he is not assigned any work?

3. If the suspended employee can not be asked to mark attendance how the payment of subsistence allowance will be regulated?

Recovery of notice pay

Sir,

In a case the services of an employee has been terminted after disciplinary enquiry on the ground that he was unauthorised absent. Now can we recover the notice pay of three months from the employee on the ground that he abandon the service by his act which resulted termination. Pls guide. If citation is availble pls provide . THANKS

What is the correct position for withholding of retirement benefits if the departmental proceedings are pending? benefits like- gratuity, epf, encashment of leave.etc.

Applicability of the contract labour (regulation and abolition) act, 1970

Dear Expert,

I need to know the applicability of "The Contract Labour (Regulation and Abolition) Act, 1970" in case of the following scenarios:

1. A public limited company is employing contract labour at its various locations. At any individual location, the number of contract labourers do not exceed 20 but in totality at all the sites, the contract labourers employed is greater than 20. Therefore is the Act applicable to the Company?

2. Secondly, the public limited company hires contractors who eventually hires contract labourers for various activities. In this case, the individual contractor may or may not provide more than 20 labourers to the public limited company. What would be the applicability of the Act in such as case to the public limited company?

Validity of technical degrees through distance education

Sir,

After the judgment of division bench of punjab and haryana high court the degrees have been declared invalid. what will be the future of a person who is in service on the basis of said degrees.

Execution against third parties

there's an arbitration award passed wherein the Claimants have been awarded certain sum of money to be paid by the respondent and further it is held that money which is lying in bank a/cs of the firm shall be given to the Claimants and it is further held that certain sum which was kept as security deposit with a third person shall be given to the claimants.... now the Respondent has obeyed the Award and has also given a no objection to the Claimant to get the other part of the Award enforced ... but one of the Bank is not ready to release the amount to the Claimants... so also the third person who has the security deposit is not obeying the Award .. stating that they are not parties to the Arbitration proceedings and hence not bound by the Award....
What course of action could be taken??? can execution proceedings be filed against the bank and that third person???
please help....

CAN LEGAL PRACTICE MAY BE DONE BY A MP OR MLA?

recently apex court has held that the mp and mla can continue their practice as advocate during their tenure as MP and MLA. Can any one provide me the citation of the judgment. I am needing it urgently. news items in the internet shown is od dated 25/03/2012.
