Mact case (husband is not considered as dependent of his wife)

hi,husband file a petition against the respondents after the death of his wife in road accident.
at the time of argument i imposed the objection that the husband in govt job and earning 26 thousand per month. "he not be considered as dependent on his wife".
the learned judge agreed with my point but he want citation on this point.
so please anyone send me the citation or precedent on that point.

Insurance investigator report

hi,
In MACT case the insurance investigator report is admissible or not in court.
fact of the case, petitioner is husband of deceased and i cross examine him after that case fixed for RW but the insurance investigator send me verbal report which is mention that the petitioner is done second marriage. so can I give application to court for re-cross examination the petitioner and what is the admissibility of investigator verbal report in court

Application to amendment the petition

hi,
the petitioner file a petition in MACT tribunal for death claim of his wife.
I am defending the insurer company in this case.the vehicle NO. which is mention in the FIR of accident case and in above said petition is not match with the insurance certificate which is submitted by the party.
after that i move the application to striking out the name of respondent. but without giving reply of my application the petitioner move another application to amendment the petition and stated that the vehicle no is wrongly and mistakenly mention in the fir. he also stated that the correct vehicle no which is match with the insurance policy is mention in chargsheet and other document.
my Q is if learned judge allow the amendment application then the nature of the case will be change so what i do now

Order 1 rule 10 struck off respondent name.

hi ,under order 1 rule 10(2) with sec 151 of cpc.
the application in above said rule when we moved in the court behalf of respondent to struck off the name of respondent as improperly joined. before filing the written statement or with it.is there mandatory to file the written statement.

Mact act case

hi,

so is there any way to dismiss or struck off insurer company name from the above said petition.

Share in grandfather property

Dear Experts,
we are living in delhi. my Grandfather(GF) has 8 childerens,3 sons and 5 daughters. my GF was expired few months back. my mother is a widow. my GF has the some agricultural land in rajasthan in his name. my GF signed a will indicating share of sons in the property and signture of the two witness.
Now we want to sell our share in agricultural land for urgent need of money due to my sister's marriage. for this purpose first we have to transfer such property in our name.
please suggest me how to transfer such property in my name ???
my uncle & Father's sister is deny to come to the court for signature verification etc. bcs they are not interested to transfer the property.
Please guide me is this possible to transfer the property in my name without their signature..???

Bank account statement not proved

hi, i file compliant in consumer forum against O/P-1 life insurance company.O/P-2 bank of karnatka.the o/p1 face the case but OP2 declared ex parte.after that i tender my evidence which is bank account statement.which not proved by the bank because they are ex parte in this case.so my Q is that bank account statement which is obtained from the master computer of concerned bank. but not signed or stamped by the bank will be admissible in this case or not. and how can i admissible that statement in forum

Our fare amount not received

"Sir one of my customer booked e-tickets from me (we are small eticket agent) They assured for payment within 15 days. After 15 days they have not attend my calls. If I visit their company always commit today within today or within two days. One of our friend told to lodge compliant in police. Is it ok..?. Is this criminal mistake..?. We effect much by this payment now."

They assured to pay some particular day through SMS / email. And requesting to book tickets.As the promise only we booked.But after that stopped booking with us. In the same time they are booking tickets from some other agents.

application for production of document but failed to produce.

hi, i file a consumer complaint against the insurance company.at later i filled the application for production of original document which is in the custody of insurance company.the forum order them to produce it but after three chances they give statement that,they have not find it yet.they submitted when they find it. my Q is now i can exp the photocopy of that document or some thing else
advice me plz
