(Querist) 13 June 2013 This query is : Resolved
Dear Experts,
we are living in delhi. my Grandfather(GF) has 8 childerens,3 sons and 5 daughters. my GF was expired few months back. my mother is a widow. my GF has the some agricultural land in rajasthan in his name. my GF signed a will indicating share of sons in the property and signture of the two witness.
Now we want to sell our share in agricultural land for urgent need of money due to my sister's marriage. for this purpose first we have to transfer such property in our name.
please suggest me how to transfer such property in my name ???
my uncle & Father's sister is deny to come to the court for signature verification etc. bcs they are not interested to transfer the property.
Please guide me is this possible to transfer the property in my name without their signature..???
Plz help me...

At first you will have to mutate your name in revenue document, it is called as heirship inquiry, then on the basis of will names will be entered in the records(presuming that ppty is self acquired ppty of your "GF")once your name appears in the revnue record then you can transfer you share in it. You will have to contact revenue authorities of your area for above said heirship inquiry.

the property is registered in the name of my Grandfather's father in the books of "village's record keeper (called Patwari).

is the presence of my uncles & aunts is required in the court...??? is it mandatory the signature of the all the uncle & aunts in front of megistrate...???
can we trnsfer the propert in our name only.???

For heirship inquiry at Pawari office, you alone can move application alongwith affidavit containing names of all the heirs, you can execute the affidavit before Executive Magistrate or Notary at that presence of other heirs not required. then on the basis of will the names of persons to whom the property is bequeathed can be entered.
