Maintenance

Husband contacted second marriage. He used to pay maintenance during his life time. After his death his second wife is getting family pension.

Weather the first wife can claim maintenance against 2nd wife who is drawing family pension of her husband.
Please clarify with authority.

Weather any criminal case can be instituted under section 420 of IPC and 138 of NI act in one case.

Sufficient service of summouns

I filed a suit for injunction. along with the suit I filed the petition for ad interim injunction. Hon'ble court was pleased to grant exparty interim injunction. I complied the Rule 3. Rule was served on the defendants. I received the acknowledgement. But the defendant is not taking the summons in suit proceedings.
Service of Rule 3 notice is sufficient notice is sufficient service of summons or not ?

Dismissal of plaint

Sir,
In a property dispute case in Delhi, initially the plaintiff has filed a suit for possession and damages against her elder married daughter on the basis of a Will typed on a plain paper, but never produced the Will in original despite several orders. Now the plaintiff has filed a another suit for granting probate in her favour. The suit property is basically allotted to displaced persons of East Pakistan who had forced to come in India leaving behind their ancestral properties there. Please clarify the following points:-

1. Before filing the probate case the plaintiff had all the opportunity to file initially the original will in any of the courts including Delhi High Court and prove the Will. Since the plaintiff has failed to submit the original will during this years, can I move an application for dismissal of plaint mentioning various grounds including ancestral clause.

2. If my above said point No.1 is not so valid, then in that case, can I move an application for stay of proceedings. Kindly advise me appropriately. Thanks

sole arbitrator awarded and directed the respondent to pay the amount to the petitioner. Order is exparty order. respondent intending to challenge the order. please provide format.

DVC after death of husband

one lady filed case U/s 498 A of IPC. Her husband filed petition to declare him as a guardian of their minor child by handovering the minor children from her. That lady filed maintenance case against her husband.

After some time all the matters are compromised and started living together.

After six months again quarrel started between them. One day elders sit for compromise. Due to this stress husband died due to heart attack on that day only.

After that that lady filed succession petition before the court for some properties by keeping mother-illa as R1.

Now she wants to settle the matters. So She filed case under Domestic Violence act against her motherillaw and all her relatives to threaten them.

Is it maintainable after death of her husband ?

What mother illa has to do?
