Verbal representations

In a crpc 125, wife filed MC in sept 11 husband filed counter in july 12 ( day on which court wanted him to file) after counselling sessions....

7sept 12 was fixed for enquiry by judge...but it was posted again by court to 22.11.12 .. on that day judge was on leave and hence again posted to 20jan13.. nearly 5 months over after filing counter affidavit by husband.... wife has not submitted her proof affidavit nor exam in chief....at this stage...suddenly wife started telling verbally to judge that husband did not submit counter....husband denied it verbally...

1. can husband file memo concerning delay and wrong verbal statements by wife??
2. or is it better to wait till wife files proof affidavit or exam in chief ..

Counter to be signed


In a crpc 125 case, the husband filed counter (named counter affidavit) as party in person with his signature alone,,,,, without any attestation from a advocate /notary.. is this acceptable?.. or can it be challenged.

Forced marriage of a boy/male

What if a male/boy (Adult) is getting married forcibly (say on a gun point) to an unknown girl which he never met?
Suppose, a boy is visiting his cousins marriage and someone kidnaps him and after a couple of days he returns home with 7-8 people accompanying him saying that he is married to this girl, they threatens the boy's family to accept the same and leave the couple over there.

I just wanted to know what are the laws to deal with such an unwanted thing. What should the boy do after returning home if he is not able to accept all this?

Crpc 125

my wife has filed crpc125 for maintenance after fighting and sending me out.. there was no valid reason but my interfering in a daughter who has just fallen in love might have caused her hate me and file a case to distance me. she has a little mental issue because of this and made a file a case as though I ran out and I do not give money, she has enough funds of mine. She with 3 daughters lives in isolation, even if I provide money as maintenance it would not solve the core problem. I see court would not come for such help.
Hence I am thinking of filing Interlocutory Application for medical help and agree to pay interim maintenance till the case is disposed.
The judge and advocates do not look at this case in such a way to save the family. I am much concerned for the family safety and security

Please advise.

Divorce case

My lawyer filed judicial separation in April2011. 1st Mediation in Dec 2011 failed.Maintenance case is going on Domestic violence case is going on. CAW cell returned all the articles including gold and silver wahtever was available with me. Police raided my house yesterday -nothing was found. Wife still wants to live with and I am not ready at all.

I am just wondering how would this case be solved -MCD they are not cming.
Please guide.
I am going to produce proofs where she is with another boy at Rajasthan - at one of the hotels and 3-4 more photographs with the same boy.

Residuaries.


If a mother is survived by only 2 daughters and the only son had predeceased the mother.

1) whether the daughters each get 1/2 share or a 1/3 rd residue remains and it will be distributed among brothers and sisters of the mother if alive or their legal heirs.

2) whether brothers and sisters of mother comes under residuaries.

Abstaining from physical relationship due to dowry

hi
it is allged husband is abstaining from physical relationship due to dowry demand not met, earlier charge mention husband was impotent never had relationship with wife.

when i challenged them to undergo medical test, they have change charge to husband avoid having physical relationship because is dowry demand not met.
and wife had force him to consumulate the marriage.
and there were lot of instance of bedroom failure.

all the charge are false, but how can husband prove the truth, when wife is saying he is potent, but avoid relationship
