Divorce

(Querist) 13 December 2012 This query is : Resolved 
A Husband got exparte decree for restitution of conjugal rights against his wife. After that also, the wife not turned out with him. The husband can go for remedy of Divorce against that wife after one year from the date of the decree.
Is there any ruling to waive the waiting of one year statutory period?

There is no right to any of the courts except Supreme Court of India to waive such period.

You shall have to file execution petition under order 21 Rule 32 of CPC after passing your decree under section 9 of CPC.
