Maintenance

In a divorce case filed by the petitioner wife, she has demanded relief as under:

1. dissolve present marriage on the ground of cruelty.
2. Monthly maintenance till her second marriage.
3. Alimoney for defamation.
4. Any other suitable order as the Court may grant.

She has not demanded interim maintenance and the Court has not passed any order related to it.

Now after one year of case can wife demand interim maintenance while in original petition she has not?

Wife has admited in her petition that she is job at mulund. In this senario wife is eligible for maintenance or interim maintenance? Wife is Commerce graduate with 68% and doing CA course. She has appeared for the CA exam also. She is well qualified.

Can the Judge now Suo motto pass order for maintenance?

Now can wife file case u/s 125 of the CRPC Act demanding maintenance?

Cheating, cruelty, abuse.

Hello Sir,

I have been cheated and am being abused mentally, physically. I was married 4 yrs ago in US in a Hindu temple. We paid large amount towards dowry.I realize that his family carried out a nice drama for the sake of money, and their plan is to get rid of me now, as his studies are done and he is in a decent job now. He creates a situation and abuses me, and clearly pushing me towards running away from him, but speaking out sweetly.

I am tired of his tricks to make me run away on my own. I really want to go away from him. But I want to see that other girls donot get cheated by this family again, like me. His family and some friends were involved in the drama. How can I bring them to justice in India ? Under what sections can I recover the large money we paid to them ? I belong to Visakhapatnam in India, Would highly appreciate if I can get a good advice from learned lawyers.

Passport impounded

I got a letter after 2 months from MEA,India that my husbands passport is impounded a month ago who is presently working in Australia.I do not know his present resident status earlier he was on long term work visa.

Pls advice that what should I do now and where should i report now so that he can be called back to India to face teh trial pending against him ?

can he still work and live in Australia?

Urgent

my husband got married to some other girl and left my 6 months old son and me n was sending us money regularly but now when i tried to go to courts for our rights he threaten me that he will take away my son from me by saying that i m not good for my son as i was on trail for couple years for car lifting and was on provision period f an year which is over.

Urgent

my husband married in november 2010 to other woaman in his native place in the presense of 500 people.
he was married to me in arya samaj mandir in 2008 and we 6 months old son.
he has not left any proof with me.
i have duplicate of marriage certificate of that which given to us by arya samaj mandir and couple of photographs.
i have his reception photos with other girl and my sons birth certificate.
i stay with my parents in punjab and he stays with his wife and mom in chennai.

Complaint us 498-a ipc

whether the complaint us 498-A, 406 IPC is mantainable in the case where a man & woman were earlier divorced and thereafter married each other.

Grand fathers property

Hi,

498-a/406, 125 crpc and permanent injuction.

A property was purchased by the father in the name of 2 minor childern of the first wife and 2 major childern of the 2nd wife. the mother was the guardian in the minor childern and paymnt was made through her. some time later a 3rd child was born. which has no name in the mentioned purchased property. Property was divided between the 2 minor childern and the other major childern. Both father and mother has died without any will. it is also pertenent to mention here that the wife of third child has filed a case u/s 498-
a/406 against the husband and in-laws including the minor child family. The 3rd child wife is demanding her husband share in the poperty. She has also filed a 125 crpc in which court has granted interim maintainace of Rs 4000/- p.m. and outstanding is around more than 2,00,000/-.

Can the 3rd child who has no name in the property can ask for his share ?

Can the childern of the 3rd child who has no name in the property ?

Can wife of the 3rd child who has no mame in the property ?

Can wife or childern of the 3rd child who name is not in the said property can ask the others brother to provide share ?

Can the court grant reliefe to the 3rd child wife in the terms of his share in the said property in lieu of the maintanance ?

Adding new grounds to divorce petition

There is a divorce case filled by husband under HMA 13 with case number N/2011. Husband has put many grounds, but he did not put some of the other grounds his wife used to harass him with– like wife blaming him for her miscarriage and wife blaming him for stopping her from work.


He did not put these as grounds of cruelty in the divorce application because wife would have simply denied making such allegation or would have denied saying anything like that to her husband. It would have gone against husband and judge may think that this husband is trying to act smart by blaming his wife of saying and things which she never did.



Now wife has filled maintenance and RCR suite in the same case N/2011. She has put above mentioned two allegations – husband being responsible for her miscarriage ad husband stopping her from work. Husband has strong evidences to disprove these allegations. He also want utilize these allegation from his wife in his divorce suite – to show that wife used to level such false, wild and baseless allegations to mentally harass him.



Is it possible to get these points( wrong allegations) considered in his divorce petition too? How can he get these allegations added in his divorce suite? Does he need to file rejoinder? Or Since the case number is same will it automatically be considered in divorce petition in trial?
