Taking back 498a wife

Wife filed case for divorce on the ground of cruelty. After one year she is no able to prove allegations hence she want to return. What precaution should respondent husband take before accepting back?

let her withdraw the case in court. the fact that she has withdrawn the case on her own
free will will help in process of reconciliation .

Thanks for Reply.

Suppose she withdraw all her allegations and return to home, but in future she might repeat all the things and at that time she will get injured to herself or file 498A compliant before living home than it will be miserable situation for husband. At present there is no ground for husband for divorce. Either defend case or try to convert case into mutual consent divorce. No one can predict future. I hope that she will return with good mind and good intention.

Ideally a lady who files a 498A knows that it would result in the arrest of all the persons who have been named in the FIR and if at any point of time she was in such state of mind that she wanted to harm you to such a extent its not worth taking her back. But its your personal decision on the circumstances and your opinion on the same.

The legal steps that you need to ensure are already advised by other members.
