I am going thru a divorce case. My wife never let me meet my son so I got visitation rights from court to meet my son from 10am to 12 noon.My wife created a lot of tnsn at the last time when I went to meet my son so I filed contempt of court(still Pending).I asked the court to gv me one day's custody to celebrate his bday on saturday or sunday, The court has told me to celebrate alone my son's bday alone on the roof of my wife's maternal house. My parents r denied any right to meet their grandson . is it a correct decision

if wife has filed a complaint under 498a consisting of false allegations then what should be done?? if the wife mentiones all those jewellery articles and items in the complaint ,which were never given at the time of marriage . Then how would the husband prove that he had never taken it.For example wife writes in the complaint that 5 sets of gold were given which were actually never given.

Hi,
My brother's wife is living away from him from last two and a half year. She filed for RCR after my brother filed for a divorce. court gave permission to my brother to meet his son but as his wife didnot let him meet his son, we filed contempt of court against her. She went to the women cell after it but there were no chrges proved against my brother after the investigation.Now she has filed 498a against all the family memebers. Please suggest what should we do???

My wife had lodged a FIR against me and my mother in the first week of August. I and our family are residing in another state then:
1) How to get anticipatory bail from their native state. Advocates are telling that its a difficult work to get and I have to spent Rs. 2 lakh for this AB. whether We have to go there to get AB also. My old-age mother is heart patient and she cant walk.
2) Is it possible to get AB from my residing state? Here lawyers are telling that they need copy of FIR.
3)How they can arrest me in another state without taking permission from my residing state police? what they will do?
pls guide me urgently..

i heard that property comes from father by inherited transfer is ancestral.
but i got property from both my father and uncle by partition deed.
the land i got is 10 acres the owners are father 5 acres and uncle 5 acres.
now i ask you under which law says that property got from uncle in partition deed is ancestral or self acquired?
what is the right of my children over my property?
all are got separate share.

my uncle and my father together transferred 5 acres each to me by doing partition deed.
if the property is said to be ancestral it must come from father by inherited transfer but i got property from my uncle as a partition deed.

Husband lease out his house after wife left his house. Now the lessee is in possession of house.she filed a suit for injunction against forceful eviction from the house and injunction order is in favor of lessee. The husband and wife joined together and wife filed a petition for residence order. The court passed an order of residence as per section 19 of DV Act. The lessee filed a petition to implead her as respondent in the petition and filed a petition to modify the order under section 25(2) of the act. Court saying that she will not come under the definition of respondent. I am interpreting that " and against whom the aggrieved person has sought any relief under this Act" what you say

Hi,
Could you please advise what could be my share in the property based on the below points.
1) Originally My GRAND FATHER has one Immovable property.
2) He died intestate.
3) Then My Father, who is only son to My Grand Father Married 1st wife.
4) As she is issue less (doest not have any children), My father married 2nd wife ( My mother)
5) My Father has two sons through my Mother (2nd wife)
6) Now, my Father also died intestate.
7) After some time, My Grand mother also died.
8) Now First wife, second wife and second wife children(2 sons) left with.
9) Do we get any share in that property left by My father and grand father.
Defintely, it will be appreicated for the advise.

Rcr pending in court and wife not appearing in court. what to do.
Dear Sir,
My wife is staying at her parents house for last 1 year and i have filed a RCR. For the last 3 hearing, she has not come and judge has done a the case as ex-partie.
Also in last one year, i have gone multiple time to her parents house to take her back and every time she says she is ready to come but will come in some time or so and things are passing like this.
I have one 9 month old son, and i want to take custody of my son.
My lawyer advised to file a case of child custody n next hearing of RCR when i have to appear.
I want to get rid of her but want my son. Please suggest.
