Dear All,
My wife had some mental disorder which I got to know within 10 days of wedding .She stayed with me and my family for about a month .Its around 5 and half years that she is at her parents place which is near Lucknow .(God has created another chapter - She gave birth to a girl child also at her parents house and child is now 4.5 years old)
I do not want to keep her due to her mental disorder . Also she had TB and was under medication at the time of wedding but her family concealed this from us . I understand that it could be cured so I did not make that a issue. But somewhat I cannot live with a girl whose mind is unstable .
Its almost 6 years and my life is ruined .I want a divorce .Now ,When I talked to her family about divorce they are quite adament and threaten me that now they will see me !!!!
I want to know can she put dowry harressement and domestic voilence cases on me now (after 5 and half yaers that she is living at her parents place). Is it possible? She stayed with me in 2006 only for 1 month and its 5 and half years that we are living seperatly . Now when it is clear to them that I want divorce can they put false allegations to harrasse me??
Where they can file cases ?? Delhi or their town ?.They are from a small town near Lucknow . I live in Delhi , Wedding was performed in Delhi and girl stayed with me that 1 month in Delhi .So to harrass me can they file cases in their town??
How can I take divorce. They will not leave me easily.

Definitely your wife can file the mentioned cases at her nearest town court. It is possible to file those cases. You have lost a good opportunity to file a petition seeking nullity of your marriage when first time you observed all 'defects' you mentioned herein. You kept mum since last more than 6 years. Now when a threatening has been given to you then you are seeking legal help through this site.
Anyway, there is no chance of getting divorce by you on those old grounds. It is better to make conciliation or to face cases and waiting for the decision of time.
