Dear All,
I am 69 years old senior citizen , Cancer surviver , heart patient and a diabetic. I had three chidren. My elder son is 45 years old ,(lives separately from his wife ), my daughter is 40 years old (has no kids) and had a youngest son 38 years old.
I am very unfortunate mother .I had lost my youngest son recently 7 months back. He was married and has 2 years old son. Immediately after his untimely demise his widow and his in laws created a night mare for me as they grabbed my property for want of it and even tried to take advantage of section 198 . They went to women cell against me and my family that we used to ask her dowry. Good thing that they could not succeed in their dirty mission . They harassed us 3 months day & nite .Initially local police helped them only.and finally they patched up and left my property after involvement of higher authorities of police.
Her parents within 20 days of my son’s demise had declared that they will re marry her .Sooner or later they will .
Even after all these false allegations /cruel fights /property grabbing / I had patched up just for the sake of my only grandson .It was decided that my daughter in law would be living both with me and with her parents .But all these were words only .She lives with her parents .With lots of Nakhras ,in 15 – 20 days she comes only for 1-2 day that too when we used to call that we are missing the kid . Initially she came like this but now when kid while going back to Nani’s palce make a fuss and cries she has stopped coming .She makes ‘Bahanas’. When I ask okay we will come and bring the kid for 1 day she misbehaved with me .I miss my grandson a lot. I live alone in the house and cries 24*7 for my son and grandson. I do not know where to go , what to do.I am under severe depression and have no hope and nothing to look at .
One hand she is doing this to me on the other ,she wants "no objection certificate" from me for susccession of my deceased son's business . She and her father has already grabbed my son's computer buisness on the 2nd day of demise of my son and now they are running it . I guess the clients are asking for No objection for the same as I am legal heir for 1/3 portion .She has dropped the hit to my daughter about it but she never disclosed that why they want it .Just said because of our fights they are saying to bring this certificate .
She is behaving like this even before having this no objection certificate . I am sure after they will get it she will not let me neet the kid .
Now pls tell me what remedy I have to meet my grandson. If she will not bring him at my house with mutual consent what can I do (she has alreday started doing this )? Can I claim custody of the kid after he has become little bit big and when this girl re -marries. Pls advise .This kid is my only hope and nishani of my son.

Dear All,
Please advise me. I got married in 2006 .I live at Delhi and girl is from Lucknow.This was through newspaper . We did not know the girl & her family and unfortunately did not do any enquiry etc before wedding . Immediately after wedding we noticed that my wife is having some mental disorder (could make out from her abnormal behavior ) .
Apart from this at the time of wedding she was having TB and was getting treatment for the same but her family members hide this from us . They also lied about the education and age of the girl .
I and my family tried to just let go TB and other lies but we could not take her abnormal behavior and we called her brother and bhabhi to discuss the matter with them . They rather feeling sorry for the concealment of facts agued and misbehaved .They refused that girl has any mental disorders . My wife was sent to her parents’ house with them and it was decided that all her medical tests would be done a fresh and she will return back with past and latest medical reports . It was just 1 month of marriage .
They sent the past TB report by courier but refused to send the latest MRI etc .After 15 days they sent SMS that she is pregnant and is on bed rest .We wanted them to send her back so that we can take care of her and would decide about her pregnancy with this TB .They did not sent her back saying that bed rest is on. In these 9 months her brother and bhabhi made 2 visits and they always misbehaved with us. In between my mother got seriously ill but they were not even bothered to ask about her health .They created no room where we can think of patch up .Finally she gave birth to a girl child in Lucknow .
Since then she is at her brother’s place. In between we tried to talk but somehow I am not convinced about the mental status of the girl .In all the 3-4 meetings we had in last 5 years with girl ‘s brother/sister they just tried to send her back without acknowledging their mistakes and without any assurance on the girl’s mental disorder. They says she is all okay . And in all these 5 years relations have become very bitter.
I cannot live with that girl . Its almost going to 6 years that we are married and living separately in different cities . Recently I called her brothers to Delhi to talk about mutual divorce but they fought and went away with a note that divorce le saktey ho to lay ke dikhaoo.
I am in total frustration and just want divorce . I have given 10000 times thought to the idea of living with this girl , even thinking about the kid jiska ismai koi fault nahi hai but I cannot live with her . I will die .Even the idea to call her gives me severe depression I know I cannot prove that she is mentally ill but I want divorce .
Pls guide me. If I put divorce case where it would be fought .I live in Delhi …girl live in Lucknow and our wedding happened in Delhi . My mother is very old and she is very very ill and recently we lost our only younger brother so there is no one in my family to take care of my mother .Can on these grounds the case could be done in Delhi.
What you suggest me on divorce .In how much time I can get it .I am already 46 years old and I simply want to get rid of this unwanted relation . I know I have a kid also but I have no other way to deal with this situation.
Pls suggest. Thanks for your time.

My self is Rohit verma. MY marriage is took place on 14/5/2008 acording to Hindu rites by the way of phere. That after the marriage as husband and wife we cohabiting together. The son born out on 2/04/2009. from the very begning of the marriage my wife is not happy in a joint family and she started to pressurized me to live and dine separately from my parents and she started maltreating and misbehaving with my parents oncertain occasions and started quarreling with me with very petty things. My wife is dancing is dancing on the fingertips of her mother and the mother of my wife is interfere in the matrimonial affairs of our life. On 21/07/2009 she left the minor child at home and started residing at their parental home. I along with some respectable persons bring back on my home. But she did not mould her behavior. Meanwhile, after one year my father take my wife with him. And did not send him back till the date. Please suggest me 1) what I do. Somebody guide me to file section 9. After that 2) Can they file any case on me? 3) She is doing govt job can she claim for maintenance ?

Dear Sirs,
my whole family falsely trapped in 498a and DVC cases.My divorce case is running from past 3 years ...Girl nor her her lawyers are coming to the court proceedings. Trial is not yet started from 3 yrs. Judge simplying giving dates from 3 yrs making me run after the court.How can make court to start trial or for fast process of my divorce case? I need to file any application in High court...my lawyer is always in the intention of compromise with huge money...Plz tell me what petition I have to file for divorcecase to be closed with in 3 months ?? plz help

Hi Experts,
wife left her matrimonial home,she is issueless while leaving her matrimonial home she also took away her sister in law`s daughter who was 2 yrs old in nov 2010,husband filed divorce petition in june 2011 & her sister in law filed application to SSP on october 2011,after application wife filed suit for permanent injuction after one week,where she mentioned that baby is her adopted daughter.Now plz suggest what is another remdy to natural mother? there was no adoption between them.can natural mother can file complait case to mazistrate?

is it possible for my nri husband to divorce me without my knowledge..
he left me in india with parents for delivery 2 months back since then he is not taking my call and answering my emails, his mother is also not answering our calls.
after marriage my in laws took my signature on a blank stamp paper saying they wanted to make affidavit to change my maiden name, can they misuse that paper for filing divorce or something?

The place of marriage & last residing place of wife is different from the wifes residing place from where she has filed 498a case .The complaint indicates that all crimes were committed against the victim at her place of marriage or the place where she lived with her husband. The complaint indicates two incidents where the native place of wife was brought into picture
1- " all accused came to wife's house during Roka ceremony (a ceremony when both families decide6 months before marriage) and desired for some gold coins".
2- " After 6 months of marriage , husband comes to wifes place & demands for money, car etc"
Besides these two incidences, there is no other incident cited to be committed at wifes place except that all the accused & co-accussed demanded for money through phone calls etc"
Can there be any relief as there is little cause of action at wife's residing place??
(or) At-least can there be quashing of proceedings against co-accused as they have not even visited wife's residing place even once after marriage???

This May we got married..After 4 months in September c went back to her Mother's home and sent Mutual Consent Divorce agreement...After family discussion, i signed the papers...At that time my in laws said that till 02nd November court is close, on next day we vl file petition and v vl get decree till April...But now i came to know that till September we cant file petition and it will take around 8-9 months more after that..i.e. June 13...

My Family Matter case settled at Bangalore Family Court in the Mediation. She agreed to withdraw all the cases; I filed one Petition U/Sec.482 Cr.P.C. in Madurai High Court for quashing her 498A Case. Court asking to file Certified copy of FIR and Chargesheet; I don't have, is there any other alternative, or any case citiation is there, to file without FIR and Chargesheet

Sir,
I Applied for 2nd appeal against sessions court order for my divorce petition dismissed. Eeven though number was given during Nov'2009, till date it was not listed.
