Whether a woman insist to file a complaint, whether it is necessary to get report from protection officer of women and child well fair department ?
what is the effect of a complainant if her allegations in her petition are not standng to the test of cross examination ?
Whether such a women can immediatly get the custody of child before her petition is decided ?

i was served summons in my brother's DV case to company address without mentioning the building tower and seating number(incomplete address),hence the reception has refused to take it. The opposite has filed exparte order on this.
1) what should i do now? does the court issues any warrant on me ?
2)How to defend my self here ?

My friend's husband is pestering her for a separation...He wants her and their kid to live separately ...He is agreeing to pay her a certain sum of money every month with a flat on rent...My question is if he writes all this on RS.100/- stamp paper and is signed by both of them will it hold good in the eyes of the law if a)He doesn't uphold his end of the agreement b)If he stops paying their agreed maintenance money.Thank You

Dear Sirs,
Can I submit the list of questions before I start cross examination to the Hon'ble Judge / Court, that I have prepared for cross examination for divorce case. If yes, should I submit the questions on the day of cross examination or submit the list of questions vide a memo and continue cross examination.

can anyone please let me know that can my family force me to sign an affidavit stating that i will marry as per their wish only???cant i marry the boy i wish even if they dont agree to him???is such an affidavit valid???i wana marry the boy of my choice.but i cant till 3months.so in between if they make me sign such a doc is it valid???

I got married in 6th june 2010,in Jamshedpur,we came to Mumbai after marriage,were i stay with my family,sir everything was good for 2-3 months but the girl whome i was married,suddenly changed her behavior,and always make convinced to send her back to her home.finelly my father droped her to Jamshedpur,but sir after going there she never called me,neither received my and my families calls ever.we tried a lot,to make her come back,again i went there to take her back,but she did not come infront of me.after that i came to mumbai,and in january 5th 2011,i filed a case to take her back,but she was never presented at any of the following dates.after that she filed a transfer pettition,and take the stay order from mumbai to jamshedpur from high court.and also filed 498a injamshedpur angainst me.now in november i went there for bail,but the court has ordered for mediation,again i went there for mediation in 21st november,but again she did not attended the mediation too,and given some foolish reasions. now sir i need to ask u that in this respictive case could sec crpc 177 act will work??can she has to file afresh case in mumbai,as i heard from someone about this act.can sec 177 could effect her?or there is any other sec which can help me out; i relly need your help. regards.

Surname change for child in passport

I got divorced in 2008 and have a male child from my first marriage.I have remarried in 2011.The divorce order clearly says I'm the sole custodian of the child and my ex-husband has visitation rights.My ex-husband is not paying any maintenance currently but he gave me a one time alimony of Rs.1 lac which is in a FD in my sons name.But since 2008 he has not visited my son even once.I know that my ex husband has got remarraied and lives abroad.Also he has changed his name and is appearing in the govt.gazette online.
My current husband works abroad we have planned to relocate.However my sons passport has expired.Im aware that I cannot change the biological fathers name in the passport.Can i change the surname in my sons passport?
Also the passport authorities have told me that at the time of applying for my sons passport renewal Im supposed to file affidavit G and declare that I couldnt get the signature of his biological father quoting reasons which has to be attested by a magistrate.How soon can i get this done?
Pls advise as Im stuck up with my son in India and not able to join my husband abroad.
PS: Im from South India and we dont have specific surnames.Its the fathers/Husbands name that we use as "Surname". So in my sons passport-fathers name is last name and his name is the first name.
So a name change as a whole is also not allowed??
