MY FRIEND AND HER HUSBAND BOTH ARE ROMAN CATHOLIC AND NOW THEY WANT TO TAKE DIVORCE FROM EACH OTHER. BUT AS ROMAN CATHOLIC CHURCH INSIST FOR ANNULMENT HOW THEY CAN FILE THE SAME IN COURT TO GET DECREE FROM COURT.. WHT IS THE CORRECT PROCEDURE

Today interim maintenance order has been passed by the court which is 5000 rupees per month and it should be given from the date from which my wife had applied for it ie past 5 months,is there any way to make this amount lesser or to bring any stay order on it or any order so that i don't have to pay the maintenance for past 5 months

My name is Ravi BharatK Gandhi and i am stuck in a problem the problem started when we both were in Mumbai in 2010 after the month of may when my wife submitted a letter to the mahila committee about me verbally and beating her up.After some months we received a notice from the court of rishikesh that we had to there for the court hearing.I went to rishikesh to try to convince my wife to come back with me in front of the judge.She was adamant not to come back with me so in the next hearing it was decided that i have to give my wife alimony of RS.5000 p.m.I traveled to oman in the month of may 14 2011 to look for my new job which i am currently employed and i have been working for 2 years.After i traveled to muscat after some months i got court summons stating that i had to pay RS.65000/= or go to jail but i did not accept them for not paying the inspector of goregaon police station came to my house with this and i was in muscat at that time.After this i heard from my mother that a Non-Bailable warrant was issued in my name this means that if i come back to Mumbai i will be arrested on the airport itself.I want to finish this case. When i traveled to muscat i had my wife's phone number i sent an sms that she was demanding RS.4,50.000 i told her to settle for RS. 3,50,000 only after giving this amount she will sign on the divorce paper.So Experts tell me what to do how should i solve this.

Mutual consent divorce was arrived at a particular amount; the 6 month cooling period is due in next 20 days however there is a change in circumstances -
1> the girl has supposedly got married to someone, obviously in a closed environment
2> and has got a job and earns a handsome salary
Note: No Alimony was paid; it was decided to appear in court after cool off period and if the decision remains to separate then money would be deposited in court treasury and court would proceed to pass decree.
My understanding says Alimony is not required to be paid if she is settled in her life.
Questions -
1> I need time to gather witness regarding her secret marriage, how can I delay the court date?
2> Can I make the company as a witness and court have them sent summons to appear and confirm that she is working with them ?
3> Can I sue the boy who has got her married, obviously after finding out who he is

My brothers wife filed 498A and DVC now is is about 5years till he is paying the maintenance amount monthly I have a doubt when the women is educated then is it necessary to pay and next is how to go for fast track and quresh the case sir. please advise.

As my divorce case is going on from one year and my son is with my wife who is staying away from me from last 3 years and dint allow me to meet my son,now i had filed a petition for child custody,on what points should i ask my layer to argue with them to get my sons custody

The lady L is married to person P1(love marriage). The lady L left the person P1 without taking divorce and got married to another person P2(arrange marriage). The first husband P1 started telling to second husband telephonically about their marriage and for evidence he supplied the UPSC call letter indicating P1 as husband of L in the handwriting of L, and the residential record of husband is also indicating the name of L as wife of P1 in the record of P1 residence with signatures of P1. When P2 (second husband of L) wanted to know about the facts from L see and her family members started torturing P2 for filing various false cases against him, even they have threshed the P2 and his family members and started demanding money. And lady L left the company of P2 without his consent. Then after this the P2 has filed the case of declaring their marriage as null and void under section 11 of HMA. Now the question is whether the documents are sufficient for the case to proceed or not? Please reply.....

Can divorce case file even 498a is running
Hi Experts,
Please help
1- Divorce case can be filed if 498 case is filed..?( summon still not received,6 month passed till chargesheet submitted).
2-If ground is false 498 case etec...for divorce...then wat will be the arguments..did chargesheet saying no witness found is helpful for filing divorse.
