Mere papa ka doa jagah zamin tha ek village m aur ek city m.Aur jo city m zamin tha wo mere Papa, Mummy k naam s kharide thae aur Mummy to 1980 m hi chal basi. To mere papa marne s phele batwara kar k gaye thae city k zamin ka aur mujhe v hissa diye thae. Lakin ab mere bhai Dara rahe hai ki wo zamin mummy k naam s tha aur papa batwara kiye thae to sab khatam ho jayega, Cout m case kar dege to.

Sir/Madam ... Mai Court s Batwara Chahata Hu lakin kaise karu yeh sab nhi janta. Meri Purko ki Jamin hai Mere Papa nhi rahe aur unke marne k baad ab mere bhai lakh kahne p zamin nhi dea rahe. Meri beti hai uski shaadi k liye mujhe zamin chahiye bechane k liye. Mere pass Sab rasid hai Original Jamin ka Kagaz hai jo ki meri great grand father k naan s hai. 1932 ka .. Plz koi bata dea lakin mai kaise karu .. ha mere purko ki zamin m s kuch zamin Dam banane m gaya hai to mai fir s zamin abhi kitna hai wo nikal k case karu kaise karu kuch samaj m nhi aa rha plzzz

Sir,
I contested a case of 125 Cr.P.C.on behalf of muslim husband, on the ground that wife is illegal wife as she has not obtained divorce from her earlier husband before marrying with my client.
But court has ordered to pay maintenance from the date of application. Which is Rs 70000/- in total.
Should I file revision or appeal in district court or may directly approach to HC.what will be better ?
Generally revisional/ appellate court direct to pay maintenance first. But my client can't pay. How can I avoid such directions.

How to file Counter claim after Issues have been framed
ISSUES have been Framed on my LAST date 25-10-2013 AND ORDER REJECTING MY WITNESS SUMMONS APPLICATION and….
Next Date is 06-01-2014 kept for Leading evidence and List of documents( IN PROCEEDINGS against the Petitioner's petition seeking Divorce from me and Maintenance for her and child under 24 HMA)
I am interested in the Divorce more than her... But On My Grounds...
INTERIM MAINTENANCE STAGE ..BYPASSED AS FOLLOWS...( NOT IN MY FAVOUR AS FOLLOWS )
1. 1st Perjury COMITTED by Petitioner
Petitioner has come to the court with Unclean hands by denying her Employment and Saving Bank account No.1 On AFFIDAVIT...I got her bank Documents in the Court through Witness Summons. But on the Same date when Witness summons were issued, she Got ADHOC Interim maintenance passed in her favour since the matter for interim maintenance got delayed for more than 2yrs....(06-08-2012)
2. ( LAST TO LAST DATE 14-10-13)...2nd Perjury by Petitioner
Petitioner wife left the old job and she AGAIN denied On Affidavit that she is not in service against my appln for production of Documents with regards her new employment and against direction by court to file her affidavit of Not in service...2nd Perjury
3. Along with this Affidavit, on the same day, she filed an application Stating HER INTERIM MAINTENANCE and other pending applications b heard simultaneously and expeditiously along with the petition to meet the ends of justice.
HON,BLE COURT filed this application as not pressing for her interim maintenance at this stage... AS READ AND RECORDED . HE DID not take my SAY ON THIS APPLICATION.
4. HE REJECTED MY WITNESS SUMMONS APPLICATION FILED ON THE SAME DAY ...TO HER NEW BANK WHEREIN HER SALARY WAS BEING DEPOSITED WITH RESPECT ...TO HER NEW EMPLOYMENT WHICH THE PETITIONER HAD DENIED ON AFFIDAVIT THE SAME DAY.
Hon,ble Court took her SAY on my Witness Summons Application ....wherein she stated its a frivolous application and that MATTER b kept for Issues cause i will get the opportunity at the trial stage.
My question.
1.) IS IT NOT AGAINST PRINCIPLES OF NATURAL JUSTICE THAT ...MY SAY ...OPPOSING HER APPLICATION should have been taken by the Hon,ble Court in the first place before passing an order on the same to avoid Matter from being kept FOR FRAMING OF ISSUES without my say on the same specially when a Perjury application is pending with respect to her first denial of not in service ..(refer Para 1 )
2.) How can i file my Counter claim in the same suit to get divorce on my grounds NOW THAT ISSUES HAVE BEEN FRAMED... (PLS quote Order and Rules if possible.)
pls pls pls .... tell me that there is a waY out...like ammendment …additional issues ...or anything and how ???
3.) Should i file a WRIT petition against the order which was passed rejecting my Witness summons application and without giving me a chance to give my SAY on her application to hear all her applications simultaneously..
4. AN INTERIM MAINTENANCE ORDER TAKING INTO ACCOUNT HER PERJURY ETC ...WOULD HAVE HELPED ME GETTING HEALTHY ACCESS OF MY DAUGHTER WHO IS NOW BRAINWASHED AND WHOSE CHILDHOOD PHOTOS WHICH ARE PRICELESS MEMORIES I DO NOT WANT TO FILE IN COURT.

Hello All,
My wife filed Cr.Pc.125 for interm maintance Rs.35000 and total Alimony Rs.25 laksh.
1.She is post graduated completd her MS in Nanaosicense in USA.
2.And her father was a Vice president of one IT company now he has resigned.
3.she is having younger sister.
4.She is having own house in her getting rental income and having property in land form also.
5.Her father and mother having lot properties from their side.
6.She was doing part time job in USA and earning and I dn't have any proof for the same.
7.After seperation she was going for Job ,now they are saying that she has resigned.
8.considering my family am from below middle class my parents are uneducated and they are depended on me.
9.I dn't have any property apart from my bike and only earning through my job.
10 Am working as a R& D engineer and earning Rs.50000 /month (take home).
11.Am having personal loan paying Rs.16000.00 per month and rent Rs.10000.00 per month and all other expenses medical etc....
12.In this situation can anyone tell me how much Court offer to her as total alimony and interm maintance.
13.How it will be calculated ,whether they will consider all above said facts of mine.
14.Note they have filed Dowry case 498A sece 3&$ against me and my family.
Furhter considered the following points:
15.My wife & her father arrested been to Jai for 10 days latter released on Bail .
16.Reason for Morphing my sister,mother and my photo in to nude body publishing in Facebook & pornograpic websites arrested under IT ACT 2008 ,66A,67A & sec 4 Tamilnadu Womens harrasment prohibition ACT
This is flased in all media
17.I have filed total 13 complaints not only with cyber crime ,CM cell tamilnadu,Huuman Rights,Womens Commision and etc...
18.Considering the 498A ,they have filed after the Cyber crime complaint only ie After their first warning from the Cybercrime Police they have filed 498A
19.so now tell,how much amount she can get from me.

Hello to all,
My client having 3 yrs old daughter filed for divorce & 125, her husband filed for s.9 conjugal rts.
Now v hv withdrawn these cases same by the husband also and signed the settlement deed in the court, within his month 1st motion will be filed But still husband is bothering wife, How - by keep on standing outside her rented house for hours which bothers landlady n neighbors as well who force her to shift somewhere else. same thing is done by her husband in her office as well( not easy to gt job again n again n new rented house as well).
Husband is so clever that he does not harass physically. he just chase her everywhere and finds out about where, what ,with whom, how etc. give her mental torture and harassment.
My client (wife) is on temporary job she's not getting maintenance just getting some money in recurring account of daughter and minimum amount she also have to deposit p/m. She was so much frustrated with her husbd harassment that she decided to gt out of these case asap and settle with parents out side delhi that is y nt taking maintenance.
She had already been to police station fr complaints 4-5 times but nothing was done rather suggested to go to court and sort out matter through court only.
Plz suggest wt can be done.

sir, maine apni pehli ladai jeetli hai.mere sasuraal wale sab jail main 7 din ki remand per police lockup main the, sirf 1 ko chod kar, woh shaadi ke baad rajasthan apne sasuraal chali gayi hai, our woh expected hai, is liye police wahan ja nahi rahi hai. property recovery main to waise bhi dedh saal baad kya milna tha. sirf furniture mila hai, car mili hai. lekin mere liye itna kafi hai ki un logo ko jail hui. jahan per kuch bhi nahi ho raha tha wahan kuch to shuruat hui. maine aap logo ko bhi question puch kar pareshaan kar diya tha, is liye aapko ye news de rahi hoon. bhagwan hai. woh sab dekhta hai. ab aage ki ladai shuru karni hai. thanks a lot for help.

Husband asking for divorce without reasons...
I got married in Oct’12. We both were quiet happy with my life. My in laws are guru follower. Since starting of my marriage I was going to their Satsang and all. But now once my Mother in law was influencing me to take naam daan and all. I told my husband that I am not prepared yet. He discussed the same with her mom. On Aug’13 he told me to go to maternal home and get your mom along. My parents came and both the families had heated arguments. They had only the household things to discuss. And one of their Mamaji said to go back (to me and my maternal family) as both the families were angry and promised us that they would again keep a meeting next week which never happened. On 27th September they called up my Jiju and told him to take away my car as the insurance was due and they won’t be liable for any theft. And the next day we again went to their home. That day they said that we don’t want to patch up, again the arguments happened and his Mamaji again promised that they will send my husband to meet me on the very next day, but again he didn’t cum. After that in mid of October I went to my sasural by ignoring everything that happened, my father in law didn’t opened the door and said that my husband is no more living with them (I saw inside, my things which I took as streedhan was not there). Then in October end I filed an application in an NGO so that we don’t go legal soon, and the NGO people could help us to keep a face to face meeting with them (to compromise). NGO people called up them and listened to them as well (we were not present there). They have certain issues like my parents insulted his parents, and all. And then once NGO people called up my husband for a face to face meeting of both of us, he didn’t came and said I don’t want to meet her as I want divorce (mutually). Since then we have been quiet.
I need your kind suggestion as I do not want to get divorced (as we husband and wife didn’t have any issues which he even confessed and the issues he is being speaking about are not that serious that we could take divorce). What shall I do now???? It was a marriage not a joke.
