Help!

Hi,
My husband on 24th Dec came with his lawyer uncle of his to the CAW and said they will not take me back. They tried hard to push us for MCD by telling us no point going to court and wasting 4-5 years and also threatening me that they will use their resources if we do not bow down to their demands. We flatly refused their demand and told them that they can not force us for a thing like this. They know how much guilty are they because I have solid proofs with me that shows the act of throwing me out of the house and then running away with my stuff and staying out of touch with us was a well-planned move by them.
However I am in no mood to divorce. Kindly tell me what is the next step I should take?
a) Would filing a DV case on them a better idea?
b) My husband has lied to me about his income and said he earns just 12k a month while the lifestyle led by him is pretty lavish. 27k was only the house rent that he was shelling out for the apartment we took on rent in Vasant Kunj. How can I produce proofs of his real income as I do not have much details about it?
c) What benefit would I have if I file a DV case first? Would it prevent him from putting a divorce case against me?
d0 What all can I charge him with under DV Act?

Please do reply at the earliest as my next mediation date is 4th of Jan and I need to know what should I say there in response to him saying he does not want to take me back? Should I ask the IO in front of him to register my case though I am not too knee on putting a dowry case on him.

Admendment at appellate stage

Ld Counsels,

It was alleged that wife unwillingly married and did not cooperate with husband for consummation of marriage.

The case was dismissed. After filing of appeal it was discovered that wife had love affair with co-worker and was constantly in touch over her phone at the time of marriage and this is also the reason for non-consummation of marriage and refusal to come for honeymoon with husband.

In view of the new discovery Can the above be pleaded by way of amendment to the original petition.

Thanks in advance.

Father extracting money from adult son - can father be legally disowned?

Dear Sir,

I'm 29 years old and my father is a brain tumor patient. He has been mentally harassing my mother and my two sisters since many years. He has sufficient funds to support the house - but he has stopped contributing to our household expenses. He is also not willing to give us any property. On top of that, he keeps demanding a part of my salary for his treatment every month. I don't mind paying for it - but he demands money inspite of having sufficient funds of his own. He isn't earning anything right now - and so I am worried that even if my mother files for divorce and moves in with me, he will demand some kind of maintenance on the grounds that he is a cancer patient and needs money for treatment. Truth is, he has enough property and money of his own. We do not know what to do. The harassment to my mother and sisters is getting out of hand now and he takes away all my savings also. Please suggest the possible courses of action on this. Any help would be appreciated

Maintenance

i got married on 24 nov 2012 and my wife left my home on 27 dec 2012. we never consumate the marriage. my wife is mba and earning more then me before marriage. I have filed divorce case for null and void of marriage. My wife has made complaint in caw cell regarding harrasment and dowry. I have retuned all the goods she bought with her and no case of 498 A was registered. No fir has been made and case is closed in CAW cell.

In front of judge my wife has said she also needs divorce. My wife has also agreed that we never had physical relations. But she is asking 15 lakhs as compensation. My questions are;
1. Is there any law which force me to give 15 lakhs as compensation?
2. If no settlement is done in mediation, can judge force me to give 15 lakhs?
3. My salary is 13k. My wife salary was 15k before marriage. I am only son of my parents and my elder sister is married. My father is retired govt. employee. My mother is in govt. job. We have our own flat. I have zero liability. How much monthly maintenace i have to pay.
