Hello Everybody,
My wife is not staying with me since last 2.5 years, I had filed RCR and its almost year now. After arguments I realized She is not at all willing to come back and also not allowing to meet child even after I have an interim order with me.
1) Can I ask for divorce under RCR due to non-following interim order?
2) If I get a decree from RCR on my side, later my wife did not come back then Can I file petition for divorce in next 6 months.?
3) Can I withdraw my RCR petition immediately? or do I need to wait for next date which is in March’14?
Please suggest.

MY WIFE AND ME LEAVING SEPERATELY FROM 3 YEARS, WE HAVE TWO DAUGHTERS, ONE IS 9 YRS. OLD, AND OTHER IS 5 YRS. ONE DAUGHTER IS LEAVING WITH ME AND ANOTHER IS WITH MY WIFE. SHE APPLY FOR DIVORCE FROM ME SHE WANT 2,50,000 RS. FROM ME FOR DIVORCE. BUT I AM NOT ABLE TO GIVE THESE MONEY BECAUSE I AM A DOING COMPUTER REPAIRING PRIVATELY ON CALL BASIS. MY INCOME IS NOT SO MUCH. SHE LEAVE OUR HOME FOR HER BROTHERS MARRIAGE AND SHE WILL NOT COME AT HOME SHE TOLD ME TO LEAVE SEPARATELY BUT I AM NOT ABLE TO LEAVE SEPARATE BECAUSE I HAVE MY MOTHER ONLY AND ONE SISTER AT MY HOME, MY FATHER WAS EXPIRED BEFORE OUR MARRIAGE.
FROM ONE YEAR I AM NOT PRESENT AT COURT. SO THE COURT ORDER ME TO PAY RS 2,000 FOR MY DAUGHTER AND RS. 2000 FOR MY WIFE AS A MONTHLY MAINTAINCE. BUT HOW CAN I PAY 4000 RS. PER MONTH. PLEASE GIVE ME A PROPER SOLUTION.

sir, please clear my doubt that whether married daughter is eligible for fathers state govt job after father is expired. I heard that new "G O" has been raised that married daughter can get the job if all the member are dependent on her. is it true or not. please clarify my doubt

My spouse and myself have agreed for a MCD. I will be getting the sole custody of our child.What are the documents/terms and conditions that i need to get to ensure that i dont face any issue in the future while applying for school , taking the child abroad ( passport and visa ) or in general anything that would require both the parents signature ?

Sir, My sister law is divorecee, First she married in year 2001 and got one daughter,but due to some problem she seprated and she divoreced, advocate made divorece deed on Rs. 100.00stamp paper and made divorece in sub registrar office,The girl is with my sister in law.She remarried and there also got some problem becuase her second husband were having childrenso dueto children again problem came and divorece paper made by advocate on stamp paper., From both the husband is having divorece deed sowing she got life time maintaince , she will no having any right on property and both parties can remarray without any objection.She again remarry,again problem arise and she gone back to parents house but this time this husband has created problem and filed ipc 494 saying that still she is wife of first husband., It is also true that my sister inlaw has filed on previous husband 498a criminal complaint.,These papers also given in complaint by third husband..pls let us know what is true., whether deed of divorece is not valid in INDIA. Pls help us. Thanks

Hi All,
I have one query regarding the DV act. My wife file DV act against me, my mother and my brother. But before receiving the summon my mother also file one Dv act on me and my wife. I am not residing with my Mother, but my wife resides on very same place.
My main concern is that is she get the residence relief as property is on mother name and she is the registered owner of that property. I also file the Section 9 on her.
Please help as i am feeling very frustrated.

Hello ALl,
My wife has filed 498A 3&4 against me and my family in the month of May.Now Chargesheet has been filed only I have received the summons from Police ,they have said my parents and my sister name has been removed.My first hering date is on 21/04/2014.
Now anyone can tell me that what my wife and my lawyer do right now?
1.can they apply for reinvestigation at this stage if it so ,what are the possibilities?
2.Can they ask police to file amended charagesheet?
3.During trial whether can they ask my parents name has to be included?If they do so,how much strong the case is?
4.As I told in my previous queries ,My wife and her father they have arrested remanded in Jail for 10 days later released on Bail based on cyber crime complaints total 13 nos.For morphing my sister ,mother and mine in to nude body publishing in Facebook and pornograpic websites.

And am also am having her medical reports which I I have treated her for physcological diseases and her accepted too all the statements am having.
Please tell me how much storng case is from my side once i receive official copy of chargesheet whether I can go for Quasing ?Within How many days Can I go for quasing?

Sirs,
I preferred an appeal in High Court for Christian Divorce. She didnt present before the Court or she didnt receive the copies filed in court.
She agreed for compromise and demanded money, and hence a memo was filed on CMA before two Hon'ble High Court Judges and the Hon'ble Court allowed the CMA and awarded divorce from the date of filing of the memo as under.
Quote:
Both the parties mutually agree that in terms of the above compromise memo there shall be a decree of divorce whereby the marriage between the appellant and the respondent shall stand dissolved with effect from the date of order that may be passed by the Hon'ble Court."
3. Accordingly, the Civil Miscellaneous Appeal, is allowed, in terms of the Joint Memo of Compromise, dated 4.12.2013, entered into amongst the parties concerned. There shall be a Decree, in terms of the Joint Memo of Compromise, dated 4.12.2013. No costs.
