My wife filled complaint in women cell and dv case in oct 2013 against 6 members and after first hearing in women cell we applied for bail for my sister and jija ji, we were directed to district court mediation center, where settlement arrived and as per the settlement i have to pay certain amount in 3 installment

40% at the time of withdrawal of case.

30% first motion

30% second motion.

It was stated that on the date of dv she has to withdrew dv case and shall also withdrew both the present complaints in women cell.

As per law the first motion has to be file in October.

Is there any way by which we can quash the women cell complaint.

Maintenance crpc & hma , divorce, dv act,

Have a young lady client with 3 year old kid from 4 years marriage, whose husband had been tormenting with unbearable character assassination, intoxicated & sober physical abuse. Beating with wires, kicking her and kid have been usual. Sister had witnessed this.

He is a driver and family at native owns a truck. he is capable of earning Rs.500 to 1000 per day. They moved into Bangalore 6 months ago and he took salaried employment since quarry activities in native was not viable.

He deserted her last week by staying in native with his family. In same town clients mother is also staying. He had once broken her head with stone and recorded statement by client was closed with mediation by police. complaint, settlement is available.

He is speaking indecently about client and her mother, including untrue incest abuses over phone. Recording of talks are available. He demands divorce and keeps oscillating in stands.

Client wants divorce. I want her to get interim maintenance, alimony and DV Act proceedings

QUERY
1. Is it better to seek CrPC 125 prior to divorce petition or seek maintenance along with divorce in IA?

2. Maintenance under HMA will it be available till filing divorce only?

3. Is it better for DV proceedings be initiated during pendency of divorce or better to file it now?

4. A notice is ready for divorce. is it better to wait for mutual or file with her seeking divorce?

Dv act- mentainance

A case under DV act is pending in Lower court. However Wife is working as Research Associate and getting fellowship and claiming that she is not employed so grabbing interim maintenance from me... I have files an application under 25 to cancel the interim and stopped paying. However she is playing delaying tactics and asking to pay the arrears first before next proceedings..
1. Can I request court not allow her to withdraw money if I deposit arrears
2. Would she be liable for case of perjury ?
3. Any other suggestion ?
Thanks in advance..

Dv ,maintenance and residence order

Wife filed 498a followed by dv .In dv she has asked for shared household and maintenance .i sold the shared household soon after 498a as I knew she would file dv and shifted to rented house which is 1 bhk flat
Now if wife ask for a 2 bhk rented flat as the shared household was a 2bhk will I need to provide her or will the court ask her to join in my present 1 bhk rented flat?
Can wife come and stay forcefully with me in rented flat without any court orders?

Rcr mediation

Re-opening the thread as it was marked as Resolved. As I am getting differences of opinion amongst the experts:

Background:

Hi Learned Members.

Applied for RCR, during the RCR mediation we arrived at MCD settlement, filed the MCD settlement on the same day which is Dec 04 2013, next date of the 13-B petition is June 07 2014.
RCR Case: My wife was supposed to file the Objections. I and my wife was present today. I and my Lawyer filed a memo to the court and brought the notice to the Judge that we have filed the 13-B petition with the case # and my advocate told that put the RCR matter to June 07 2014 and once the divorce is confirmed we will withdraw the RCR case. A copy of the MEMO was issued to the Wife and Wife's Advocate.
The reason why we did this is because my wife and in-laws are having the uncanny behaviour and change their mind any time. If we withdraw it now and if they withdraw 13-B petition we will be back to square one.

The Judge told that he cannot give such a long date but has given the date in March asked us to get one more date in March.
Am I going right in this matter. May be If my wife doesn't turn up for 13-B second motion I will any way have an option to withdraw by citing above reasons.
Is this technically permissible?
