a mahamadan governed by hanafi law of inheritance died leaving behind his wife five sons and one daughter.what are the shares of wife and each of the sons and daughter in the property left behind by the deceased.And how it is arrived at.

Q) my wife left me 4 months back and then she files police complaint against me and my parents.we went there and clear our position. then again after one month she files complaint in women cell in same city. we went again there and clear our position where my wife said she neither come back nor give divorce and she want maintenance. where as incharge women cell told her to go to court if she want maintenance. now today i got call from DY.SP office that your wife has filed complaint against you and your parents. now what should i do to stop them from harassing me and parents

I wanted to discuss the harassment in one matrimonial case which is though ordered exparte and for exparte evidences on next date. But still the ex parte evidences are not being heard on next date by the judge. Reason they give that they have 100 cases today and so the case is being adjourned continuously to next date.
Kindly help as to what is the best to do in such case.

Please help me with my another query,My husband had sent blank messages and his cousins also sent long messages(on my husband's behalf)last month and my husband is also telling others that he is ready to take us only if we go to him(every time he abused me I was always there with him and never left him). But atleast once in his life time I want to hear from him that he wants us and take us home back by himself. I don't understand if he is doing all these coz he is scared of case I filed with all the proofs or he really wants us back. My advocate told me to file RCR after I told this to her. But I'm also scared if he is doing all these to trap me. Will filing of RCR weakens my 498a and dv case u/s 326,if he repeats this in future?my intention is not to punish him or expect any maintanance,he is very egoistic want him only to realize his mistake and make sure he doesn't repeat it again. kindly help me.

Yesterday we had hearing for the divorce, our six months wait period is over, and the girl did not show up in the court, citing the reason that her relative was sick, can you please tell me how many times can she escape citing bogus reasons.
TO me it looks like she wants to harass my family till last second.
the girl tried to contact me during the wait period,saying she wanted to comeback I already paid the the agreed amount for withdrawl of 498 A cases. After all the sufferings and bad start to our marriage I do not want her back.
Is there any legal action we can take?

A marriage was solemnized and registered in India according to Hindu rites and ceremony in February 2011.The Hindu husband has a domicile of India and he is a citizen of India. Before marriage, the Hindu wife had not a domicile of India as she has been residing in foreign country since 2006 but she is a citizen of India. After one month of the marriage, the wife alone went back to foreign country in March 2011 and she has been still residing in foreign country. The husband is residing in India now. After that, Wife has filed a petition of divorce before the family court of India u/s. 13 (1) (i a) of the Hindu Marriage Act through power of attorney in the year 2013. Now, the husband has still domicile of India and he does not want divorce. The divorce case is on the stage of reply/written statement in the family court of India.
Note: Before marriage, during the marriage and after the marriage the husband has been residing throughout in India. Before marriage and after the marriage the wife has been residing throughout in foreign country since 2006. Wife came to marry in India in 2011 and resided only one month in India only.
Que 1: Can husband file an interim application in the family court questioning the maintainability of the petition itself as wife had not domicile of India before marriage and she has been still residing in foreign country since 2006?
Que 2: Does this type of marriage valid according to the Hindu Marriage Act?

Dear Madam/Sir
My client is 35 years old married under Civil law and Hindu Marriage Act, with a son. My husband was divorced prior to our marriage. My husband is having another affair at present. I have started residing with my parents six months passed. Twice I had taken poison and was admitted in hospital. Twice I filed complaints to police station. I am in need of maintenance for myself and my 8 year old son.
Please advise on going for Divorce then maintenance or Maintenance. And under which law?

How the amount of 125 crpc maintenance for a child is calculated by the Court?
Mother's income is 70k pm and father's earns 50K pm.
