Me and my wife is leaving separately. My 1year baby is leaving with my wife. I am going to take divorce with my wife but I want my baby custody. My wife is only B.A, her family is not financially strong and not able to take full responsibility of my baby. Please suggest me How can I take custody?
Can I take baby custody after 5 years? When the baby becomes 6 year old.

Sir meri wife ne 2 December 2015 ko 498a ipc 323 ki fake complaint di ti. Jo women cell me 21 dec ko jhuti sabit hone ke kaaran band ho gyi.meri wife ne fir 29 dec 2015 ko dobara ipc 498a ipc 323 ipc 361 and ipc 506 ki mere khilaf complaint ki hai.or ek mediacal certificate jo 17 november 2015 ka hai attach kiya hai.kya meri pehle wali complaint jo jhuti sabit hui ti vo is complaint me meri kuch help kr skti hai.sir 6 janury and 15 janury ko meri women cell me date thi.uske baad compaint ko mediation me transfer kr diya gya. 1 February ko meri mediation me first date thi.lekin meri wife ne mediation ko attend nhi kiya.or jab me mediator ne phone krke pucha to meri wife ne kaha ki ham mediation nhi aayenge.maine court me 498a 323 ki apne husband ke khilaf ke complaint di hai.agar meri wife mediation ki koi date attend nhi kare to kya hoga.is court complaint se kya hoga sir

Hi my wife has put dv act 2005 against me my father sister mother. I am regularly visiting court. Interim maintenance is been ordered and I am paying amount. Also I asked for visitation right she denied. Also wants to know can jmfc court cant order visitation rights.
Till date I never thought of giving divorcee to her but my wife is being cruel hence I am taking step for divorcee. Also she is not earning neither graduate for betterment of my son future can I get his custody forever.

Dear Experts
I want to know how can a father be compelled to meet the son after Mutual Consent Divorce since the visitation rights are with the father and he being a celebrity is avoiding his duty and only kept the visitation rights to bring hurdles like passport of the child, his visas and other places where his consent would be required because of visitation rights.
Kindly tell me remedies available for getting spousal support for the child welfare. No money demand from the father.

I got married in January 2010 after one month of my marriage I come to know that my wife is suffering from serious condition of Epilepsy. She was taking medicine 5 times a day even if she miss one does of that medicine she got Epilepsy stroke. My wife told me that she is suffering from this disease from childhood. We complain this matter to my in laws family because it was a cheating. They hide all that thing before marriage. Than they took their daughter with them and after few months they lodge complaints against me and family in front of SSP, that we are harassing and beating their daughter for dowry. Than SSP forward that case to local police station for investigation but During investigation police find the charges are false and SSP office made many attempts for my in laws family to attend police station for settlement but they didn't come. Than police give us letter about declined the charge of harassment. After that my wife is still living separately from with her parents. They are keep changing their address. Still we have made many attempts through our relatives and friends for settelment or divorce but they are not responding. They are spoiling my life. Please suggest me solution for that. Now I want divorce from that girl. We are living separately from 5 years.

Sir I filed hma and now at this stage judge passed on order""replication not filed. From the pleadings following issues are framed. 1. Whether the petitioner is entitled fir decree of rstitution if conjugal rights as prayed for?OPP
2. Relief
No other issue pressed by parties.now the case is fixed for respondent evidence PF/DM list of witnesses to be filed in 10 days"" what does it mean sir....pls reply if I am to pay any amount,,.,

Can DV case filed against husband and his family by wife at her native place ,be transferred to husbands jurisdiction on grounds of threat to life of husband by wife and her family members .

i had filed a divorce case exactly a year ago, the other party is not receiving the notice or even giving a MCD, we have sent the notice to the address they are staying but wantedly they are not accepting the notice, now what is the procedure for a ex-parte divorce and how long should i wait for filing for paper publication o.
can some one guide me on this please.

Regarding maintenance money
sir me and my husband staying in abroad for the last 6 yrs he used to send monthly savings to my account and we dont have children now we got some difference with my husband and especially with my sister in law my husband now went back to abroad and he is totally out of contact with me ,i told my husband the amount with me will keep in joint account but my husband want that money and get rid of me from his life ,now my husband is earning 3 lakhs per month ,i dont want to go for divorce ,shall i file for maintenance money and also domestic violence against my husband and there family members
