Dear Expert,
Please clarify, after separation husband and wife. we are not living together now. we ere separated more than 1 year.
Now i am getting threat of launching false complaint against me. is it possible to launch any Domestic Violence case against me even more than 1 year of separation?

Here is the brief facts:
1) Husband and Wife both are not legally divorcee at the time of marriage
2) Husband has dissolved his first marriage on stamp paper and wife has also dissolved her first marriage on stamp paper.
3) Both the parties are not aware that stamp paper divorce is not valid divorce so their first marriage is still sustaining.
4) Currently Husban and wife are not in talking terms in any ways since last 1 and half year. ( Not living together)
5) Husband want to draft petition and seeking declaration second marriage as void marriage under section 11.
Please experts help me.
How should I seek void marriage declaration as I am also at fault of being laymen at the time of marriage?
Note: Second wife may or may not aware that her first marriage is sustaining. Because of Dispute, She is planning to file dowry, DV, CRPC 125. She has given written application to NGO lady But The lady of NGO has not kept the application on record and trying for compromise.

Is there any provision through which any wife can demand for husband's Parents own property (property which is totally on Parents name).
second doubt is:
If they have a minor child (son), then is there any possibility that she can ask husband's Parents property on behalf of grandson.

sir when divorce petition is in pedning, husand or wife re-marry another person, will that second marriage is void or valid marriage in the eye of the law.
Sir a couple of days back i came to know through sources that Delhi High Court passed recently a judgment with regard to void marriage when first marriage divorce petition is in pending married for second time.
please suggest that date or name of the citation or supreme court citation with regard to this. that is when divorce petition is in pending, man or wife if marries second time, that second marriage is void under law.

is widower entitled for family pension of deceased wife after re-marriage, both husband and wife are in govt. job, after the death of wife the husband remarriage, is the husband is entitled for family pension (from deceased wife's)?

CAN GIVE MY SHARE OF MY ANCESTRAL PROPERTY BY WILL TO MY FRIEND??
My grandfather purchased a dwelling house.He died intestate.
On his death, it was transferred to my father's name. He died
Now it is on name of my mother and we two sons. So I have 1/3rd Part in it . Now my mother died a year back .
I have Two wife. 1st is not divorce, having Two adult children.
2nd have Two adult children .
I do not want to give anything to 1st wife or to her children, as I have no relationship.
I believe, illegal children or wife have no right in ancestral property.
Can I execute WILL TO TRANSFER MY SHARE OF MY ANCESTRAL PROPERTY TO CHILDREN OF SECOND WIFE??
Can I pass on my share of property to anyone of my choice during my lifetime??

I had deposited various complaints in police station stating my marriage is based on fraud and concealment of her medical problems viz. Endometriosis , removal of left ovary and right repaired and stated that she had done same fraud with her first husband also . she is a divorced woman. Now, the local police station had appointed an IO SI for investigation.Now , I had contacted her first husband .Her first husband had told that she had also destroyed her life and now she is destroying your's life and he also wants to meet me.I want to know that whether I should file a criminal case against her with the help of her first husband also or firstly I should take a room on rent and aftyer then my mother will file eviction suit to vacate her home as the home is of my mother only and after then file criminal case or not ? My wife is living in her matrimonial home since after her complaint in CAW cell

Hi ! Need advice on Annulment of Marriage.
I am married now for 11 months, but the marriage did not consummate till date. She has a very hairy body and a big black spot (5''-6'') on her back and a lot of other small marks(one on her toungue as well), which were not declared at the time of marriage. I had never felt to consumate marriage since i discovered all this but she is waiting and willing.She is also very rude and use abusive language as well.
Please suggest , if I can file for annulment of marriage and save myself from the stringent laws of India. We are living separately now for 6 months and the situation has gone volatile.
They have complained in women cell and how i should protect myself from 498a.

Sir,
Me and my husband (we both are muslim ) are living separately from last 2 years still married.
As of now my daughter is living with me and me and my parents are taking care of her. he(my husband) didn't even bothered to ask how her daughter is doing. and also not giving me divorce.
I want to know in given circumstances who has the legal custody or how can i get the court order or something that give me sole legal right to take decisions for my daughter as I want to move out of country. Please advise

Self acquired property - will/probate
Dear Sir,
We are two children to our parents one is myself and another my brother. Both of us are married and having children. My mother expired on 23.01.2012. My father acquired few properties on his own(not ancestral) and they are in my mother's name. Can my father execute sale deeds(if he wants to sell them) without the intervention of children and can he execute registered will or probate(to be executed after his demise) specifying division of properties between us. If yes the will/probate proforma may please be given along with details such as stamp paper value for the will/probate and the likely stamp duty for registering the document in the state of Andhra Pradesh.
