hi ,
my friend has a case against him under 419,420,471 and passport act.he got duplicate immigration stamp in his passport.he had been in jail for 2 months and now out on bail.he is getting an offer to work in abroad.he has a fresh passport also.is it possible for him to go out of india with the new passport?he will attend the court if he gets summon.can anyone help him?

Dear sir,
in continuation of my last query regarding maintenance.
sir you rightly said but.......?
1)megistrate had not listened my say and directly given the interim date
2) I had submitted few application from first date of my appearence in court.but court has not given me any reply of any application in 10 months and always one reply megistrate had no time to reply, wait?
3)without any ground of evidence just by mere words of applicant lawyer megistrate had passed interim order on the otherhand I had given more than sufficient proofs of my income but megistrate ignored everything and passed order.
Respondents dont have to wait for their number in court but they had to wait for applicant lawyer who comes by her own convenience at her own time directly entering into the court start proceeding and respondent always called later.
4) how to say and what to say in such conditions and to whom ?
5) not even a single allegation is found during cross examination but case will run till last?
6) I have experienced to what extent system works for the right person?
only guidance is helping me to some extent

Respected experts,
A false rape case is filed against me(MY CLIENT)by (MY CLIENT) x-wife.
FACTS OF CASE ARE-
it happened that after love affair for more than two year(2004-2006) we were tied to marriage as per the local custom and tradition(as both of us is ST).But due to problem we got divorced after one year(2007) of marriages as per local custom and tradition.
Now on 2007 she filed a rape case against me.
According to her complaint on 24 0ct.2004 I request her to visit my rented room for helping my ill mother,who has came to my place from my native place for treatment.At first she refused my request but after my constant request she accept my request and come with me to my rented room.As the room was locked she inquiry about my mother which I told her that may be she(mother)is in neighbor house.After sometime in my rented room I approached her for sexual intercourse which she denied and I put her suni in her mouth and rape her and thereafter I warn her of dear consequence if she tell about this to anyone and also promise her to marry him if she kept quiet.
She also accepted that after this incident she also stated to love me.
Accordingly she produced one witness,which happened to be her younger sister(aged about 16 year at the time of incident). According to her younger sister(witness),as her sister(my X-wife) was late to returned shop she visited my place and found that my room was locked from inside and then she peep through window and found that I was putting on my long-pent and zipping long-pent zip and her elder sister was on the side of cot and was wiping.After that she returned to their shop nervously thinking what to do.Thereafter I and her elder sister returned and her elder sister eye was still red.Then she told her elder sister that she know all thing that had happened.Then her elder sister advice her not to tell anyone as I am going to marry her,so accordingly she kept quit.
As all this deposition are fabricated story.What defense i should take as the case is on "DEFENSE WITNESS STAGE".
If possible pliz provide me Supreme Court/High Court judgement similar/related to above fact or which would useful for me to discard the prosecution case.
any other useful advice are most welcome.

There is some matrimonial dispute in between me & my husband,my husband has not paid maintainence amount to me,now Ld. Magistrate has asked me to deposit expenses/diet money with jail authority so that court can send him behind the bars.I want to know is it my responsbility.Kindly help with relevent provisions/Thanks

1. Can a NBFC advance &/or show loan as cash for Rs.4,50,000/-?
2. Can a loan of Rs. 4,50,000/- agreed to be paid in full through one cheque after period of one year?
3. what is the difference between loan repayment cheque and guarantee cheque under The Negotiable Instrument Act 1881?

Dear sir,
in continuation of my inquiry regarding maintenance.
wife is staying with her parents and dont want to say with husband.
child is of mere 2and half year not even in school.
on the other hand father of male is old aged and sick.
no other female in the house male has to do all house hold work also.
wife is responsible for the spoilage of husband professional career.
in such a case what court will decide the maintenance of the wife having child of 2and half year child.
