Dear sir,

in continuation of my inquiry regarding maintenance.

wife is staying with her parents and dont want to say with husband.

child is of mere 2and half year not even in school.

on the other hand father of male is old aged and sick.

no other female in the house male has to do all house hold work also.

wife is responsible for the spoilage of husband professional career.

in such a case what court will decide the maintenance of the wife having child of 2and half year child.

It is depend on your salary and importantly on required for them to bare the expenses to lead common life. No fixed amount

u cannot run away with legal obligation against your wife and son u/s. 125 0f cr.p.c. for paying maintance at the same time u can file a case against her for restitution of conjugal rights for not living with the family and violating your basic rights in the family court

when you appear in the court you can request to court to send your wife with you and you can explain the whole thing to the court.
