Querist : Anonymous (Querist) 27 August 2026 This query is : Resolved
Wife is the owner of property land done DC conversation, and Katha is on her name for all individual site is husband sign mandatory for registration?
Quick Summary
If a wife is the sole registered owner of a property, with land conversion and Khata issued in her name, her husband's signature is not legally required for registration. The wife, as the seller, along with two witnesses, can complete the registration process. The husband can act as a witness if desired, but any two individuals with valid ID can fulfil this role.

T. Kalaiselvan, Advocate (Expert) 27 August 2026
The husband’s signature is not legally mandatory if the wife is the sole registered owner of the property, the DC conversion is in her name, and the Khata (e-Khata/A-Khata) is issued exclusively in her name. Only the wife (as the seller) and two witnesses need to sign. The husband can be one of the two witnesses if he is available, but any two neutral individuals with valid ID proofs (e.g., Aadhaar) can legally act as witnesses

Husband has no right, claim, interest or title in the property accordingly wife is solely entitled to dispose it, as desired.

The husband's signature is not mandatory, as the wife is the sole owner of the property. The husband can sign as a witness if he or the wife wishes.

Husband have rights later on property if he shows his earnings only invested on property?
T. Kalaiselvan, Advocate (Expert) 29 August 2026
Under general property law (particularly in jurisdictions like India under the Prohibition of Benami Property Transactions Act and Section 14 of the Hindu Succession Act), the husband does not automatically get legal rights or ownership over a property simply by proving he funded it.
If the title deed/registration is solely in the wife's name, she is legally the absolute owner of that property.
