Order39[4] of CPC

Dear All ,

Suit for partition and declaration the CJJD court passed Temporary injunction order.we filed the M.Cic=vil appeal which was also dismiised but we found the registered document dukly signed by the plaintiff the consent is given to the previous documents executed by his brother so we filed the application order 39/4 of cpc.Please suggest

execution of sale deed by fraud

A plaintiff filed a civil suit in the court of the civil judge senior judge cuttack for cancellation of the sell deed dated 07.04.2007. on the ground that she is an illiterate harijan and childless widow and taking advantages of her situations. the defendant got the alleged sell deed executed by practicing fraud and misrepresentation.

Order VII Rule 11

Order VII Rule 11 application is pending in High Court as a same suit of partion is pending in Trial Court.
The palntiff in trial court is Respondent no. 2 in High court and he has withdrawn the Suit in trial court after we have file 7/11 application in High court.

Is our 7/11 application still maintainable ?

when objection against exemption under limitation act raised by defendent is made after issue is framed or when the plaintiff file plaint to get exemption ?

CONSTRUCTION RELATED

SIR,

WE ARE CONSTRUCTING A HOUSE ON OUR PLOT AS PER MAPS PASSED BY MUNICIPLE COMMETTE AND TOWN PLANNING DEPPT OF THE DISTT.FIRSTLY WE ISSUED SUMMON BY COURT FOR CASE BY OUR NEIGHBOUR UNDER RULE 39 1 AND 2 WITH CPC 151 FOR WHICH OUR LAWYER ADVICED US TO GO AHEAD WITH CONSTRUCTION. NOW AGAIN WE HAVE RECIEVED ANOTHER SUMMON UNDER RULE 39 2A CPC.OUR LAWYER SAY AS WE R CONSTRUCTION AS PER MUNICIPLE COMMETTE 'S MAP .SO THIER IS NO NEED TO HALT . KINDLY GUIDE US THEN WHY WERE SUMMONED AGAIN IF WE ARE NOT DOING IT ILLEGALY.

Greetings !

I want to know whether the photos can be taken as valid proof in family case if the photos are not having negatives? The photos were digital and the photographer is not ready to come to court to give any statement. In this case, is there any photo test which can be done by laboratory which tells whether the photo is original or mixed one. Here mixed means changing the actual object and placing different one? Is there any such test and whether this test report is taken as valid proof or not in the court?

Unregistered WILL !

Dear Experts of the Forum,

Some where in the same EXPERTS forum, i read The unregistered Will is not use full, and court will not accept the same . Is it true?

Is there any limitation if it is not REGISTERED?

Who can Challenge the unregistered WILL?

In particular case, the property had come to a person Mr.A (dead now) from Mr.B ( Through Registered WILL, long back,and this is not challenged by MR.B, at any time in his life time!). Mr. A parted this property to his Off-springs...A1, A2, etc.,Can off-springs of Mr.B, challenge the Will of Mr. A, which is unregistered? This pertains to the state Of A.P.Is probating is necessary in A.P state?

Unregistered Society

Hon Members,
Can unregistered society sue someone on the proposed name,if no then please send me the recent case laws of that.
