Original will vs intestate succession

Hi All,

I am doing a small home work and I need your ideas in answering my question.

If the registered WILL is lost and the beneficiaries (who are legal heirs and also the executor) are aware of its contents, can they mutually choose to follow intestate succession because they feel that the testator has made unequal or unjustified bequeaths and they agree to equally divide properties among the family members?

In other words, under what circumstance, a WILL can be cancelled or rejected by a beneficiary if they feel that other legals heirs (who are not included) should also get benefitted?

Tenant not vacating the house in bengaluru.

I have given the house for rent at Rs 8500/month and made 11 months Leave and License agreement during the Corona wave 3, when the market rents were low. In 2023, the market rents went up to Rs 13,000 - Rs 15,000/-, in line with pre-Corona rents. Now the tenant in May 2023 onwards is not agreeing to pay Rs 13,000/- rent during renewal, and also not vacating the house, when asked to either pay Rs 13,000/- or vacate. He is just paying increased rent of Rs 10,500/-, which he only decided(initially he increased to Rs 9500/- for few months and then to Rs 10,500/-). What to do now?

Sale deed in name of son who is living abroad

Currently for job I am living abroad and I am purchasing an appartment in Bangalore. I cannot travel to Bangalore for sale deed however I have planned to buy the property in name of my mother. Is it possible that my mother can execute sale deed being my gurdian and I am being the owner?
Please also advice what other possible ways to keep the property in my name and not being there physically

Right release deed

Good evening.

is the release deed equivalent to the self acquired property or ancestors property.

I got the ancestor's property of my grandfather from my brother (his share) through release deed.
Now is this property considered as self acquired property or ancestor's property by law.
Do I have a right to sell or write a will to anyone of my family members.
Please clear my doubt. Thank You

Will unregistered witnesses expired

Local commissioner appointed plaintiff did'nt produce any evidence WILL was accepted by district court saket plaintiff reapeal and judge appointed local commissioner my advocate cross examining plaintiff she lies certain answer, now plaintiff advocate told commissioner that plaintiffs has no evidence so close from there side now next my cross examination on next date. I have orignal WILL of my father which first and last WILL.
One witness son ready to submit his affidavit that his father sign as witness but second witness son has gone abroad selling his property I don't know how to prove 2nd witness.

Pl. Help me

Settlement deed

Builder built 8flats instead of 6flats as per approval plan. He deceptively hold some UDS out of plot and clandestinely obtained property tax assessment for the unauthorised flat and after some time he raised a settlement deed in favour of family members. But In the settlement deed approved plan details not mentioned. Such frauds can be enquiry under section 82 and 83 of registration act. Please explain the position. Thanks

Society maintenance charges not paid - discontinued maid

Is maid servant an essential service or non-essential service. Maid servant is coming to the flat, which didn't pay maintenace charges for 2 years. Maid is for only cleaning etc service to the flat. Not for any medical or nursing help. Maid servant does floor cleaning, utensils cleaning etc work. Not for help to senior citizens. there are 6 people in the house. Husband, wide, 3 children(20+ age) and one grand mother, who is hale and healthy.

Slum property transfer and sale.

Dear all
Kindly help me in this matter.
I have purchased property in slum in 2012 from Mr. X and execute sale deed, Affidavit and irrevocable power of attorney. All documents are Noterised.
But the property was in name of Mr. Y ( Brother of Mr.X) who has given power of attorney to Mr. X for maintenance and sale in 2000. ( Power of attorney is notarized)
My question is that
1. Can Mr.X sale the property me in 2012 on the basis of irrevocable power of attorney. ( Power of attorney is notarized and not registered in 2000)
2. In Annexure 2 the name of Mr. Y is appearing. How can I transfer the same in my name.

Land purchase

Sir
My seller is having original document year 2015. No other chain document. This land belongs to his husband and he didn't transfer his title thru any document. After his death and release from their 4 sons she got the rights over the land. Her husband got this land thru general possession (pothu swatheenam). Can I buy this property? If so what other document will I need to be legally safe.
