My problem is that-
Property is situated in Ajmer Rajasthan, Actual owner is died, and one of his LR is shifted at Australia and got nationality. and my client wants to purchase this property. what document is required and how can Australian citizen make power of attorney for that property. please suggest me full law and procedure.

rent agreement

hi... what is the best way to come out of tenant and landlord dipute. is it safe to enter a oral agreement between the land lord and tenanat regarding the tenancy? what is the evedentuary value of the oral agreement before the court of law?

one individual dwelling unit MEANING

I am buying a residential plot. In the MoU it has a point which says:
The property mentioned herein under will not be used for any kind of
commercial purpose like putting up of telephone booths/ tailoring shop/ cyber
cafe/ coffee shops etc. it can be strictly used only for residential purpose and the
Purchaser also confirms to the Vendor that only one individual dwelling unit
would be constructed and NO multi-dwelling unit nor Apartment would be
constructed.

Can anybody explain me the term "only one individual dwelling unit" and the meaning of the above mentioned point. Does this means that if I construct G+2 floors, I can not give the floors on rental purpose. FYI this property is in Bangalore.
Answers would be appreiated.

Landord wants me to evict.

Respected Sirs,

I have posted two queries regarding a rent dispute between myself and my landlord and respected Experts were kind enough to give their expert opinions which was very useful to me. I am sorry to trouble you again regarding this.

I am paying rent (Rs.2000) regularly to me LL every month for a shop portion in T.Nagar Chennai . LL not issuing receipts. When asked for receipts, next month I shall give, next month jointly I will give he said. Meanwhile dispute arose between me and him during April 2010. LL then refused to accept rent and asked me to vacate. Meanwhile 4 months passed. I sent 4 months rent by DD alongwith my Lawyer notice. LL accepted the rent and converted the no rent receipt period of 18 months as non payment of rent willful defaulter / chronic defaulter and demanded 18 months rent otherwise face eviction proceedings. Again I sent next month rent of Rs.2000 along with rejoinder stating that all rent has been paid by cash. Again he sent another reply that unless otherwise I pay arrears of rent he shall file eviction proceedings. I met my LL’s advocate (opposite party advocate) and spoke for compromise proposal by paying Rs.30,000. After consultation with his client (ie. my LL) he said that LL is not interested in compromise, he wants possession of his premises and they have filed eviction suit on 30.8.2010. My query is :

1. Now I have made up my mind to pay the demanded arrears of rent of Rs.36,000 on the first hearing of the R.C.O.P. itself by DD since I am not having the rent receipts to argue my case. Will the Hon'ble Judge appreciate my stand and dismiss the case since the arrears has been paid without any arguments / litigation.

2. After receipt of the amount, will the case for eviction proceed. What will be the outcome of the case. I am not in a position to vacate the shop since it is my old breadwinner. I want to drag this case for minimum 10 years, will it be possible for me. Kindly advice me.

This is manjunath,sir my grand mother(my mothers mother)she had three daughter in that she given her own property to her first daughter as a gift deed ,can she take back in court her property frm first daughter

Property Booking cancellation Refund of advance

Respected Sir/Madam

I am R.venkataramanan working in kanpur.
My wife belongs to hyderabad.

I had booked flat in Comfort Castle at Survey numbers 311,312 & 317 situated at nizampet village & gram panchyat Quthbullapur mandal Rangareddy district hyderabad on 19/07/2010

The agreement was executed on 19/07/2010.

The building cellar carparking is floodded with water & the car parking is completely closed

as per the agreement,the builder has agreed to sell the flat 1258 sq ft with car parking of 80 sq ft as was mentioned in the agreement for 2075700/-
out of this 375700/-has already paid to the builder
51000 thro cheque
224700 thro online internet banking on 24/07/2010
In the construction agreement the builder has signed to handover the flat with all work completed in 40 days & the remaining payment to be paid in 40 days from the date of agreement 19/07/2010
since the builder has not completed the work & the parking is closed i told the builder that i am cancelling the booking & asked for repayment of Rs 375700/- paid by me as advance
the builder is refusing

midc notice

I am Living in Thane at Wagle Industrial Estate, and this is under the Forest division and MIDC.
Recently Mumbai High court ordered in the faour of MIDC and Forest to destroy the Zhopadpatti.
since we are living in thane from 1990 and right now we are also recieved notice for the same from MIDC also notice are published in the Marathi Newspaper about their notice.
Now we dont have any house and we dont have any rights on our house and that is illegal.
Now, I and resident people of area are in tension and they want to take action against this and want to stop these activity.
right now we have not receieved any reply from MIDC that they are providing us other place/ accomodation or else.

so according to any development plan can we get the home from govt or MIDC inspite of this.
Now the Govt. are sleeping , no one want to reply on this activity . The Elected Leaders are like to dumb.
The Govt. don't know /don't want to listen, further problems of every citizen.
Like Education, employement, House, etc.

please let me know all about these matters and request for your valuable suggestion because we have received 1 month notice and i dont have any house to move, even in the mumbai the rent of a month is near about 5000 Rs. so it very costly for us working on 7000 rs.per month.

What can i do in this situation? i am not having that much money to take decision of a lawyer and file a complaint against this.


Please suggest us.

Parking spaces for cars

In a recent ruling the Apex Court had held a builder bringing up a multi story building can not sell portion of common areas in ground floor either as a covered or open to sky car parking space for owners of the flats. In our building containing 178 flats, the builder had sold quite some of the portion of open/covered spaces around the building on first come first served basis to purchasers. It appears nothing prevents the owners to appeal to the builder to return the money paid quoting the order. Once they realize the money they forfeit the right to park the car in places reserved to them. The areas become property of the association of owners. Will the same apex court order come in way of the association collecting any charges from the owners of the flats if they park their cars in common areas? Whether the say in the matter for the association is curtailed to ensure cars are parked in open/ covered areas without hindrance to one another?
