Assignment agreement done/ bank lost original paper

Dear COncerned

I have signed an assignemnt agreement for an apartment in Bangalore and given 20% advance. The apartment is ready to move in and Registration is due as of now. The seller had a loan with LIC. I am going ahead with some other bank for loan. Now when my bank has sought for a list of originals held with LIC we got to know that LIC has lost his original sale aggreement. LIC is sat=ying they are ready to give declaration that seller has given them original copy and they lost it. They are also giving me certified copy

1)Now if the seller closes the LIC loan and registers the property and then transfer it to me what the legal implications of this?

2) If I persuade my bank to sanction loan on certified copy then what are the legal implication i may have in future?

3) LIC is giving me an option that if I take the loan from them they ll forego the certified copy matter and sanction me loan for now and later I can get it transferred to where ever I want after registration in my name

AFter registration in my name whats the value or legal implication of older sale agreement?

Kindly hel

Minor share involved property - they took advance, but not applying for court permission

Sir

We have paid advance fo 14 lacs for a house property.

Property Details - Land bought by husband and wife together & house building constructed.

Survivors - Husband passed away, leaving behind wife and minor son

The wife has taken an advance of 14 lacs and almost over 9 months, not applying with the court at all for obtaining approval for minor share sale.

What remedy we have?? The sale agreement has been registered.

Can we approach the court directly for the same purpose, stating that the concerned person has not taken any action??

Thanks a lot.

Igr issue in registration - can registration will cancel ?

Dear Sir

I have got a house loan from a bank and registered a property by calling commision .
The property was already running on loan from the same bank . So , there is case of book adjustment also from the bank on the seller account .
I have paid the registration charges and stamp duty . The TDS is also paid . My contribution of 20 % by demand draft is also paid by me . I have also paid the 3.09% service tax to developer , as the seller has not registered the property before .
I also have a possesion certificate from a developer .

The registration was done by calling commision and bank has given a xerox of check to seller and asked him after getting the IGR from registered office , to take the physical delivery of check .

Deed mentions about a book adjustment value , check number and my contribution draft details .

Now , today when the seller went to Registration office for IGR , it was not provided as the registration office told him that , the extra 1.1% of stamp duty have to be paid as the property was not registered before and then only IGR will be provided .

The seller and bank is asking me to pay this amount otherwise registration will get cancel , as book adjustment will change.

Kindly advice , is it possible that registration to get cancel and my money getting stuck by no fault of mine .
They are forcing me for 1.1% but I dont want to pay .
I need urgent advice . PLZZZZZ

Sale of property

Dear Sir/s,

We have sold one property (in a reg. co-op soc) in Mumbai for a XY consideration. Firstly, the deal was done orally on 22/08/14 in the presence of some persons, where the total consideration has been decided. Thereafter the buyer has paid a partial token amount. On the day of dassera, buyer has paid remaining token amount thus making total token amount at 9% of the deal value. All the token amount was paid in cash in the presence of two witness. On the same day buyer has requested us for a key of the property for one day, as they want to do a pooja of their new property on the day of dassera. We did it. On the same day, we prepare a draft on plain paper stating that seller has agreed to sell the said property at a XY price and buyer has agreed to buy the same. It is also mentioned that documentation process and remaining payment will be completed before 05/12/14. The said paper has signed by buyer and seller. But till 05/12/14, the buyer could not arrange the funds, hence nothing has proceed further. Buyer has requested us to extend a time period till 31/05/2015. We agreed to it. Buyer is in process of sale of one of his flat, but due to his higher expectation, sale could not take place.

Now what could be the possible outcome if buyer again on 31/05/2015 failed to make payment. Can he ask for a refund of token money? We do not want to refund the token amount as we have abide by him for almost 9 months i.e. from August 2014 to May 2015. Apart from this, the market condition is worsting now. We have sent one email to buyer telling him that if he fails to make full payment by 31/05/15, our deal will be terminated and amount paid by you will be forfeited. We orally requested him to confirm our said email. But he is not doing so. What is the legal remedy in the matter? Can he compel us
for the refund?

Request for your reply.
