My Uncle had a unregistered sale agreement with a buyer. The buyer did not perform according to the contract so my uncle cancelled the contract and forfeited the 10% deposit.
Two years after the contract date my uncle transferred the property to his children name.
Now after 2 years from the contract date the buyer is filing law suit for money recovery for double deposit, with interest & cost.
We know my uncle's case is very strong but lets assume 1% if my uncle loses, can the buyer recover the money from the property with the money judgment. Because now the property title is not under his name and he has no other assets.
What is the worst can happen if he lose.

A tenant made an agreement of sale with landlord, but landlord sold the property to another person.Tenant filed OS in City Civil court, against the landlord. The judge gave the decree order against the defendants to execute the sale deed, excluding the purchasers. In execution the same court dismissed the decree order. WP filed in HC which was withdrawn and dismissed, the judge gave the opportunity if RFA is failed in HC,your at liberty to file revival.
Whether HC directs the decree order?
Please give me the solution...

My dad bought a company in 1988, he has also taken over loan from the sellers of Tamilnadu investment corporation. The two sellers had made a release deed (viduthalai patram) and sold the property to my dad's name. My mom and dad were partners and now after my dad died I took over my dads position. Patta is in my dad's name.
My dad cleared the TIC loan and he got the patta in his name and he has also got the recipt from TIC for the loan clearance and property has been to my dad and company name.
But the release deed (viduthalai patram) is not registered in the register office.
Now will this create any problem if we wanted to sell this company property.

Dear Sir
In yr 2010 we 5 friends booked a flat at Titwala by paying 1 lakhs rupees each. The title, NOC, CC every thing is ok.
In the year April 2014 we completed the registration procedure & paid the builder 2 lakhs each.
As per Registration document the Yr. of completion of building mentioned is Dec 2015.
But till today the builder has not yet started the construction work.
Please help me to know how to proceed with such builder, what legal action can be taken against him, & how we all will be benefited.

Dear Sirs, Date: 06 March, 2015
1. The father ‘F’ has written a WILL and a CODICIL bequeathing his immovable and movable properties to his two children (a son ‘S’ and a daughter ‘D’) and four minor grandchildren. Both the will and codicil have been registered. Subsequently, the father ‘F’ has written a CODICIL NUMBER TWO making some changes to both the will and the codicil. But CODICIL NUMBER TWO has not been registered.
Is the unregistered “codicil number two” valid? Will it be accepted in a court of law along with the registered will and codicil? Or is it necessary to register codicil number two also to make it valid?
2. In all the above mentioned three documents, portions of properties have been bequeathed (i) to the two minor granddaughters (md3 and md4) born to daughter ‘D’ and (ii) to one minor granddaughter (md1) and one minor grandson (ms2) born to son ‘S’. Both the two minor granddaughters ‘md3’ &’ md4’ born to daughter ‘D’ hold AMERICAN (USA) Passports. All the remaining persons (viz. father ‘F’, daughter ‘D’, son ‘S’, and two minor grandchildren ’md1’ & ‘ms2’ born to son ‘S’), hold INDIAN Passports.
The questions are (i) do the two minor granddaughters ‘md3’ and ‘md4’ holding American Passports are eligible to get shares (through the WILL) in the properties of ‘F’ (ii) do ‘md3 and ‘md4’ become coparceners to the properties of their mother ‘D’, since the properties of ‘D’ are not self-acquired (iii) similarly, do ‘md1’ and ‘ms2’ become coparceners (by birth) in the properties of their father ‘S’, which he acquires through a WILL ?
I request the learned advocates kindly to provide me the clarifications and also guidance in the matters 1 & 2. Many thanks.

Is it possible to Alienate a property when the partition suit is still pending (i.e framing of Issue has not yet done by the Court)???? Any Case reference
Property on gpa with agreement to sell
A property was purchased in 1996 from original allotee of industrial plot from Haryana Govt. The documents given by seller were original possession letter and conveyance deed from Haryana Govt. besides GPA in purchaser's family name, agreement to sell, receipt for payment, affidavit but no will. Now purchaser wishes to get the property transferred in his name but the whereabouts of the allotee are unknown and the department wants GPA to certify that allotee is alive and in case of his death NOC from legal heirs which again is not possible as the whereabouts of seller are not known. Someone suggested issuing a public notice declaring that sale has been carried out in 1996.
Please suggest some solution.
